It's his shitty writing. I looked it up, and the initial audition is the cattle call. Anyone can audition for that, you don't need permission. As @StinkySnack said, he hasn't been banned from trying again next year (yet). He wouldn't need to sue for that. What's confusing is there are in fact two auditions. The first is watched by a producer. That's the one where Russ thought he was on the show because the producer said "good job." The second audition is the first round of AGT. There are a limited number of slots in initial round of AGT where contestants audition in front of the celebrity judges. Those are prerecorded and aired for the first few weeks. Then the judges winnow down the initial pool of contestants to those who will appear on the live rounds. Russ is asking they either create an extra spot just for him for the first round, or bump someone who qualified on their own merits and put him in their place. Either way would be massively unfair to the other contestants, but I doubt Russ even considered that and if he did, he doesn't care. Russ can't write clearly to save his life, so it's understandable there's some confusion over what he's actually asking(demanding).What I raise issue with is that in all his amended complaints he consistently refers to him skipping the audition as "judge ordering him to perform". In his injunctions he specifically keeps asking not to be ordered to perform, but to audition.
Maybe I'm just reading way too deeply into his bad writting
Now, it's quite possible that Marathon, or even NBC itself bans him from further auditions for any of their productions. Then he might file ANOTHER suit demanding to be allowed to try again.
