He probably could, but that would take years to ever reach any kind of resolution. The whole Jewell and Sandmann cases only got settlements as quickly as they did because of the widespread media attention.

Well one thing he would have going for him in a suit, is that it wouldn't be hard to argue that there were damages. The site got DDoSed as a direct result of the news coverage, so there's not really the kind of speculative damage that simply might occur from the libelous coverage, which is usually what the plaintiffs in libel cases are suing for.
