I'm somewhat intrigued as to why all these delays. It could just be they have more important resume-builders, but this weird segue from "flu" to "COVID" has me a bit confused. It is such a lame excuse, the sort of thing you'd expect from a grade schooler who just didn't do his homework.

Could it be they never even read the original opinion or looked at the operative complaint before taking the case?

Could they just have looked at it and been surprised to see what looks like wholesale copyright infringement (by the OP) and assumed this had to be some mistake?

It's the sort of thing I think a competent IP lawyer could have made a triable case out of but Russ didn't. What are their "extraordinary circumstances" that would justify taking up arguments not raised in the trial court? Just being pro se won't do, especially when Russ has extensive experience in pro se litigation, as including the Fremantle/Marathon response to Russhole's litigation history as an exhibit would demonstrate.

Dumb or not, he's in a considerably better position than most pro se litigants, with at least some legal education and fairly substantial experience. He's just not willing to do any real research or even address counterarguments to his insane bullshit.

The other approach (and they probably do both if they do not just snake on Russ entirely) would be to argue Russ's arguments were sound in the first place and the judge was just wrong.
