Crime 14-Year-Old Charged As Adult With 3rd-Degree Murder In Connection To Fatal Beating Of 73-Year-Old Man: Police - Attorney of the boy asked the magistrate judge for leniency. The attorney says he just recently graduated middle school and cited that he did not have a prior criminal record or any school disciplinary actions.

PHILADELPHIA (CBS) — A 14-year-old boy who turned himself in to police Monday in connection with the beating death of a 73-year-old man in North Philadelphia has been charged as an adult with third-degree murder and criminal conspiracy. He lived just blocks from the attack.

Security video shows who police say is a teen boy holding a traffic cone winding back before he strikes an elderly man from behind.

Police say the boy in the video is 14-year-old Richard Jones. He turned himself in to authorities with his younger brother Monday. Jones is being charged as an adult with third-degree murder and conspiracy in connection with the victim’s death.

A source tells Eyewitness News that 14-year-old Jones had his 10-year-old brother with him at the time of the incident in the early morning hours of June 24. Police confirmed that the brothers were questioned on Monday, but the 10-year-old was later released. Police haven’t yet said why.

The attack happened June 24 around 2:30 a.m. on the 2100 block of Cecil B. Moore Avenue. Surveillance video shows the group of four males and three females taunting and striking 73-year-old James Lambert with a traffic cone. Lambert died the next day from injuries to his head.

Jones’ attorney asked the magistrate judge for leniency. The attorney says Jones just recently graduated middle school and cited that he did not have a prior criminal record or any school disciplinary actions, adding that some sort of altercation happened prior to what was seen on video released by police.

Family and friends of Jones refused to comment to Eyewitness News as they walked out of the Criminal Justice Center on Tuesday night moments after Jones appeared before a judge.

In court, Jones’ attorney admitted her client threw a cone at Lambert, but that it hit the 73-year-old in the shoulder.

His attorney also claimed that it followed an altercation with the victim that was not seen on camera as the group of juveniles was leaving a rec center along the 2100 block of Cecil B. Moore after playing basketball. She also says a girl also seen in the video threw the cone that struck the victim in his head. Lambert died the day after the attack.

Jones’s attorney did not answer Eyewitness News’s questions, but in court, she told the judge her client had won a community service award, played football and worked as a summer camp teacher. She asked for him to be released to his family.

The judge refused and set bail at $750,000.

Jones is being held at a juvenile center until his preliminary hearing, which is scheduled for July 26.

Crime scene tape is still left behind where the attack happened before Lambert’s life was taken from him and just across the street from a community garden where volunteers give back. They provide free food to this underserved neighborhood.

It’s a much different scene than what happened nearby late last month.

“When I saw that video my jaw dropped, my heart sunk,” Sanctuary Farm Executive Director Andrea Vettori said. “And you just have to wonder, why?”

Police sources tell Eyewitness News a girl that was involved in the attack is expected to turn herself in on Wednesday morning.

The city is offering a $20,000 reward for information that leads to an arrest and conviction in the case.

Can the DA accept those admissions and ammend charges to Felony Murder? He's there, felony happened, dude died, EZPZ. Who cares about their dindu nuffing, somebody did do something and if they won't confess throw the book.

I can already tell that this isn't some typical 5'5 little 14 year old who's still yet to grow into his body. This kid definitely already had the height of a full grown man, with the strength to back it up too.

Also, I've said it before, teenagers absolutely should have the basic common sense to know right from wrong, which means that they're not little kids anymore, and shouldn't be protected from the law just because they're underage. If you know it's wrong to catfish adults on dating apps, then yes, you should be held accountable. If you know it's fucking wrong to murder people, then fuck yes, rot in in a juvenile detention center until you're old enough to be tossed in big-boy adult prison. We wonder why there are so many fuck ups in our current clown world but too many times do we let delinquents like this get one too many free passes because he's "just a minor," and "doesn't know better."

Fuck. This song STILL is relevant to this very day with shit like this. People should maybe take the hint.

:optimistic: Just going to pre-empt this with an optimism-rainbow. This is already how the law works in theory and why the 10 year old went home while the 14 year old is getting adult charges. There's usually an age where they recognize someone understands the concept of criminality even if they are under the age of majority. Leftists like to frame it as DAs playing pick&choose when this is how it was intended to work.

I feel like this is a poor fit and I would ask you to define "accountable" here. Yes they might know it's wrong, but they're also underage little shits. You cannot make rules to effectively address a demographic that on average, has some portion of the population pathologically breaking them. If there's more than empty space between your ears you already know this to be the case with dating apps. You know exactly how the verification (doesn't) work. If you willingly choose to ignore that risk and get "fooled" into committing a crime, that's on you. The kid's parents should punish the kid but this just reads like trying to excuse pedos.
 
The 10-year-old was released and has not been charged, a spokesperson for District Attorney Larry Krasner said in an email.
Can't believe Krasner is even pretending he's going to charge the 14 yo. Krasner doesn't believe juvies can commit crimes and I don't doubt that he will drop the 14 yo's prosection as well.

The reason this isn't the case is because it'd be the immediate excuse of every adult ever. Unfortunately it does lead to fucked up cases like the 3d guns guy where he was apparently catfished on an 18+ escort app but the law as written made it his responsibility legally for not knowing the girl lied about her age.

I really don't give a shit and no one should either.

No history of bad behavior is a sound argument for why a suspect is less likely to be the perp. Maybe it wasn't him at all and the police should focus their attention elsewhere. Maybe it was him but it was self defense. In civil matters, decided "on the preponderance of evidence", that can figure into the "punishment" even if he's found "guilty". But in a criminal matter, once it's established that he is in fact 100% certain to have murdered a defenseless grandpa, it doesn't matter how well-behaved he was.

Special note - he isn't someone with "no real history with violent acts" - he's someone with "no documented history with violent attacks". There's an extremely huge difference.

He could very easily (and considering he beat a man to death for fun - very likely) have been caught doing violence but never charged/documented/etc. It's going to be more and more common as Schools/Local PDs/Local DAs just don't enforce laws, there will be no record of them ever occurring down the line.
