An Ohio man was arrested Tuesday for raping a 10-year-old girl who became a central figure in the debate over abortion rights after she reportedly traveled to Indiana to have an abortion when Ohio outlawed the procedure last month.

Arrest records and court records viewed by The Daily Beast confirm that Gerson Fuentes, 27, was arrested Tuesday in Franklin County on a felony charge of raping a person under 13. The Columbus Dispatch, who first reported on his arrest, attended Fuentes’ arraignment in Columbus on Wednesday.

The unidentified girl’s plight became national news when the Indianapolis Star quoted a doctor who said a 10-year-old rape victim, who was six weeks and three days pregnant, had been forced to travel from her home in Columbus to Indiana for an abortion. Her home state had a trigger law that immediately outlawed abortions after six weeks once the Supreme Court overturned Roe v. Wade.

A Columbus Police detective, identified by the Dispatch as Jeffrey Huhn, testified in court Wednesday that the 10-year-old victim was impregnated and had an abortion in Indianapolis.


“The victim went out of state to have a medically terminated abortion,” he said, according to video of the arraignment.

The video showed Fuentes staring blankly during the arraignment and standing with a slouch as a translator relayed the proceedings to him in Spanish.

Court records say the alleged rape occurred on May 12. Detectives said in court that police were made aware of the girl’s pregnancy through a referral filed with the local child services’ branch by her mother on June 22. Eight days later, the girl had the abortion in Indianapolis.

The aborted fetus has since been tested for DNA and entered into evidence, Huhn said, and officials say Fuentes confessed to the rape when he was questioned.

Fuentes’ arrest comes as conservative media claimed the girl’s story was made up for political theater, something parroted by Fox News presenters as recently as Tuesday night—while Fuentes was already in custody.

But those also with egg on their face in light of the horrific crime: the top law-enforcement official in Ohio.

Indeed, state Attorney General Dave Yost spent much of the past week effectively dubbing the story a hoax, suggesting he had heard nothing about any such crime being reported.

“We have a decentralized law enforcement system in Ohio, but we have regular contact with prosecutors and local police and sheriffs,” Yost said in a Fox News segment Monday. “Not a whisper anywhere.”


Yost released a statement Wednesday afternoon that did not address his previous comments.

“My heart aches for the pain suffered by this young child,” he said. “I am grateful for the diligent work of the Columbus Police Department in securing a confession and getting a rapist off the street.”

Dr. Caitlin Bernard, the Indianapolis obstetrician-gynecologist who first described the rape and its aftermath to the Indy Star, previously told The Daily Beast she expected vindication.

“It will all come out in time,” she said via text message on Tuesday.


Court records show Fuentes is being held on a bond of $2 million. The judge said he was considered a flight risk and, given the brutality of the crime, a high bail was necessary to protect the child involved.

None of the officials we reached were aware of such a case in their areas. An abortion by a 10-year-old is pretty rare. The Columbus Dispatch reported that in 2020, 52 people under the age of 15 received an abortion in Ohio.

While reporting this story, the Fact Checker had contacted the Franklin County agency to ask if such a referral had been made. Unlike similar Ohio county agencies we contacted, Franklin County officials did not offer a response.

Could some Pro-Abort Karen worker hid the info??? You would assume if WAPO came calling then the top person at the Franklin County Children Services would be the one taking the question. I hope the Ohio AG gets to the bottom of this and peoples head roll for obstruction of a rape of a little girl.

This rapist is presumably an illegal alien residing in Columbus, Ohio. I wonder if the fact that Columbus is a sanctuary city has anything to do with the ass-backwards way this entire story and arrest unfolded.

Most sanctuary cities have resolutions and executive orders severely limiting law enforcement interactions with illegals.

Some observations regarding how this story affects the MSM narrative-

There are still idiots out there who believe that the overturn of RvW means a nationwide ban on all abortions, and the MSM has certainly stoked that falsehood with their misleading headlines. Well, that this girl was in fact able to get an abortion definitively proves that wrong. Will that curb the freakshow that are the violent pro-abortion demonstrators? We all know the answer to that.

And when this story was first reported, the travesty was not that a child had been raped, the travesty was that she had to "cross state lines" to get the abortion. Well, I checked the drive time between Columbus and Indianapolis. Two hours forty-two minutes one way. A minor pain in the ass? Sure. A travesty? No. I've had to travel more than twice that far over multiple state lines to see certain specialists. And now the word is that she didn't even have to leave Ohio to get the abortion in the first place.

Anyway, in lieu of a woodchipper, I hope the rapist fuck gets put into general population at some point.

Arrest of Ohio Man, 27, Appears to Confirm Story of a 10-Year-Old Girl Who Travelled to Indiana for Abortion Following Alleged Rape

Court filings in Ohio appear to confirm reports that a pregnant 10-year-old girl could not obtain an abortion in her home state after allegedly being sexually assaulted. Instead, the girl travelled to neighboring Indiana in order to terminate the pregnancy — reportedly because of Ohio’s new abortion ban.

According to court documents obtained by Law&Crime, Gerson Fuentes, 27, is accused of rape of a person under 13 years of age in Franklin County, Ohio’s Municipal Court. He was arrested Tuesday and appeared in court on Wednesday. He is currently out of custody on $2 million bond and has been ordered to stay away from this alleged victim and her family.

A probable cause affidavit in support of Fuentes’ arrest indicates that the alleged assault took place on May 12. A police report was generated on June 22, listing the victim only as “HVN.”

“On July 6, 2022, HVN referenced Gerson Fuentes . . . as the suspect who raped her,” the affidavit says.

On July 12, Ohio detectives Jeffrey Huhn and David Phillips served Fuentes with a warrant to obtain a buccal swab, the documents indicate.

“After obtaining the buccal swab Detectives brought Gerson Fuentes to police headquarters for an interview where he confessed to raping HVN,” the affidavit says.

According to a report Wednesday in the Columbus Dispatch, Huhn testified at Fuentes’ arraignment, confirming that the girl received an abortion in Indianapolis on June 30. He also reportedly testified that DNA from the clinic in Indianapolis is being tested against samples from Fuentes and the victim’s siblings.

The girl’s story appears to be the same incident described in a Friday, July 1 story in the Indianapolis Star. In that story, which subsequently gained national attention, a doctor told a newspaper reporter several vague details about the girl’s case — and that the girl had to travel to Indiana because Ohio law bans abortions after six weeks. The girl was reportedly six weeks and three days pregnant.

The case catapulted to the forefront of the national abortion debate after President Joe Biden referenced the Star’s July 1 report in a subsequent speech.

“This isn’t some imagined horror,” Biden said when speaking about changes to abortion access during remarks on Friday, July 8. “It is already happening. Just last week, it was reported that a 10-year-old girl was a rape victim — 10 years old — and she was forced to have to travel out of state to Indiana to seek to terminate the pregnancy and maybe save her life.”

“Imagine being that little girl,” Biden continued on July 8. “I’m serious, just imagine being that little girl.”

Biden’s comments were largely aimed at attempts by his administration to broaden abortion access in the wake of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization. That decision overruled Roe v. Wade and held that there is no constitutional right to choose an abortion. In the wake of Dobbs, states were left to chose on their own whether to allow or to ban the procedure — and what rules would apply.

Ohio’s anti-abortion measure contains no exceptions for cases of rape, incest, or fatal fetal anomalies, according to an analysis by The Cincinnati Enquirer.

The Indianapolis Star’s original report suggested that the 10-year-old victim needed to travel to Indiana to terminate the pregnancy because of Ohio’s new abortion restrictions.

The president’s policy goals — and his decision to address the case of the Ohio 10-year-old— were roundly criticized by conservative commentators and politicians who attempted to cast doubt on whether the case of the 10-year-old victim actually existed.

Ohio Attorney General Dave Yost (R) appeared on Fox News on Monday, July 11, and told host Jesse Watters that he hadn’t heard of such a case as the one now alleged against Fuentes.

“Now, the doctor in Indiana isn’t in our jurisdiction, obviously,” Yost said. “We don’t know who the originating doctor in Ohio was — if they even exist. But the bottom line is it is a crime . . . It’s also the fact that in Ohio the rape of a 10-year-old means life in prison.”

Yost said on Monday that there was “not a whisper” of evidence that the rape and subsequent pregnancy occurred.

“I know our prosecutors and cops in this state, there’s not one of them that wouldn’t be turning over every rock in their jurisdiction if they had the slightest hint that this occurred,” Yost said on the 11th.

A statement from Yost’s office Wednesday praised police but was silent as to the girl’s abortion. It also did not offer a direct apology for casting at least some degree of doubt as to the facts of the matter.

“My heart aches for the pain suffered by this young child,” Yost said in the Wednesday, July 13 statement. “I am grateful for the diligent work of the Columbus Police Department in securing a confession and getting a rapist off the street.”

“Justice must be served and BCI stands ready to support law enforcement across Ohio putting these criminals behind bars,” the statement added.

Fuentes’ next appearance is set for July 22.

This story really bothers me on a visceral level. There was no verification of this story until yesterday and yet almost of all of the media AND Biden himself parroted the story for almost two weeks. Nobody even seemed to care that a child was raped and impregnated. They only seemed to care that their inability to accept the consequences of their actions was gone and were gonna use this 10 year old as a bludgeon to get their way. I don't want meaningless sperging to just be my post so I'm gonna try to work out this seething hatred by making a rough timeline. Please correct me where I'm wrong. I'm pretty MATI atm and will get things wrong.

Eliza was apparently a victim of human trafficking herself at some point, so she's somewhat emotionally invested in the situation. She's definitely biased but in the way that makes her upset the Democrats blocked the increased minimum sentences.

I'm more doing a :thinking: at why they feel the need to block the bill.

Edit: I just realized considering the Abort first investigate later nature of this case, we're VERY lucky they appearently kept the fetal tissue available for evidence. I mean they'd probably keep it regardless to sell it, but shhh. If the media had waited a week before publishing, the doctors could have safely disposed of the evidence before anyone questioned why the rapist wasn't being investigated.

Outside the political theater and awfulness of the crime: Why is a 10 year old girl ovulating with the ability of getting impregnated by rape? This isn't nature's design and hasn't been throughout our evolution. How/why/what is fast tracking girls into the womenhood realm while still being child?
Girls especially are hitting puberty earlier. Obesity accelerates it. Fat is involved in endocrine metabolism and there are theories that girls hitting a certain height/weight ratio is involved. Girls in highly sexed environments such as being abused also seem to hit menarche earlier. Then there’s all the endocrine disrupting chemicals in our water and food. All a mess really. And of course it implies she was being regularly abused.
Ok and if it becomes apparent that that is way more likely than not, then we can have a discussion about an abortion.
The issue here is that such an outcome doesn’t gradually become apparent, it happens fast. a ten year old is not only likely to have serious issues with birth but you won’t see that until birth and at that point, it’s a bit late. You have no time for nuance when you’re in labour, and that’s why so many women end up with life changing injuries. It’s get the baby out however you can and the mother just accepts the injury. I lost four pints of blood during one of my deliveries - that would be catastrophic for a child.
Or they may suddenly just have a point where there’s system failure - going back to my point above about height/weight thresholds there’s also a theory that pregnancy lasts as long as is sustainable, and that can vary depending on things like the size of the mother. So you’re much more likely to end up in a situation where you have premature birth, and a fast birth, or pregnancy failure which leads to catastrophic injuries for the mother. By catastrophic I mean things like placental abruption, or a forceps type need for delivery that can lead to pelvic fracture, and serious internal injuries and fourth degree tears (which leave you functionally incontinent.) the most common outcome short of death would, rather cruelly, leave the mother unable to bear future children. (Such a situation changed the course of British history at least once)
I personally would prefer no one ever needs an abortion, I’m quite against it, and it is always killing, I also think that as we have situations where you can kill in adult life (castle doctrine type situations) there also needs to be acknowledgement that a raped ten year old faces potential threats to her life, health and future fertility that would warrant an early abortion. To ask a ten year old to bear and deliver a baby is a horrible conundrum.
I hope her rapist gets life, or at least a long stretch and deported back to whichever hellhole he came from.
