I know I'm probably digging deep into the barrel of fails.
But I notice a similar pattern with those who are KV and the most vocal.
A lot of them were either in the system like ljmontello, their parents don't want anything to do with them (MarzGurl and Sean Schemmel), or they've trapped themselves in loveless marriages, or relationships ie: Monica, Ron and Jamie.
Or cheated on their spouses for someone else like Chris Sabat, Michele Spect
Or an ego that believes they're famous than they truly are ie: Emmett Plant and Kara Edwards.

SCOTX and SCOTUS can just deny cert. You're only guaranteed one appeal. And since this seems like a pretty cut and dried dismissal because of one party's unforced fuckup, I don't see cert happening. The only possible thing that could interest a higher court is if an amended petition is governed by a Rule 11 agreement or not, but I'm holding no hope on that.

There's possibly a motion to reconsider, but I'm at negative optimism considering how badly Ty fucked up this case. To reconsider, they would have to reverse themselves, and it took a whopping 70 pages to simply say "lol retard your motion practice sucked." They'd have to double or triple their page count to grant and explain reversals, and why would they want to do extra work?

We'll see if a motion to reconsider comes out, since the deadline is 15 days, or so says Ty.

I don't see the Texas Supreme Court granting cert but thats fine as it allows a speed run to the US Supreme Court. They could get there if they challenge the entire public figure doctrine, and combine it with the claim the entire TCPA process violated due process by requiring vic prove a case while also denying him the right to collect evidence.

That could thread the needle, and Justice Jackson would be very interested to hear that argument if his public statements on defamation law are any indication. It would definitely be a 4th down Hail Mary pass though. It would also be incredibly expensive.

I dunno. The 2DCOA strongly implied that Vic had the evidence in the form of those second amended petition sworn statements to at least partially pass on the TCPA, but for Ty's fuckup. If the appellate court had considered all evidence and still denied Vic, he could argue against the clear and specific evidentiary standard, or something, but the court literally said they couldn't look at that critical evidence because Ty couldn't get his notaries straight.

Thats why the in is to attack the entire need for the hearing in the first place. If the hearing itself was unconstitutional then Tys fuck up is irrelevant. The TCPA was a terribly written and even more terribly applied law.

I fully believe a lot of it is an act for his fans. They propped him up since 2019, and part of the reason he's not a blubbering mess and/or a-logging and fed-posting and/or hanging from the rafters is he feels he needs to stay strong for them.

Imagine if his fans had turned on him. I mean, if Squally had joined KickVic, he'd have taken his sequined pants, wrapped them around his neck, and kicked the stool out from under him.

To me the biggest way to shut up these retards will always be "if he was declared guilty as you say, then why isn't he in prison OR in the sex offender registry? Because if he was truly guilty of all that he's being accused of, he'd be in both right now" and watching them foam at the mouth trying to justify themselves.

I'll admit I'm saddened at the turn of events and was hoping Ty would be less fucking dumb, but oh well.
