The fact is that he is using this TIHYDP for his reaction video under the main premise that it's transformative enough, (and if sufficient, he would be covered under Fair Use (arguably, if you feel different I'm not going to argue you on a grey area)), however this breaks his claim of "illegal restreams".

He cannot use that term by his own standards. If the restream is transformative enough (which tend to be when they have commentary), then not only it's not illegal, it's perfectly fine.
Just like AJ doesn't (currently) want him to react to it, but he did nonetheless, and he doesn't want other people reacting to his content, but they can nonetheless.

He's out of that argument.

It's going to happen and I think the process is already starting. Not sure if it's ego, but his refusal to see a dentist has caught up with him as what person with normal teeth winces in pain whenever they eat something like a hot dog? I could see why people are hesitating to go after Phil, at least in this season with Wings getting hit hard and Nulls comments about going overboard on A-Logging. Phil IMO is in this weird spot were a strike like that, losing another whale or some consistent weeks of no money could put him in some serious cow-tipping territory and I've been having this inner debate if him starving out would really give something more entertaining than whatever monotonous slog the alternative is. You are right that it is similar, but the difference is Phil is doing it out of spite and pettiness. Most detractors did it to show that Phil is a unredeemable piece of shit who scams his audience out of money, showing he is a hypocrite, and overall is a disgusting human with no morals.
