Two thoughts have crossed my mind reading this, one as a hypothetical and one as a result of re-reading the provisions of Protocol I. The first is that hypothetically, an individual who "volunteers" as a foreign member of a nation's military (French Foreign Legion doesn't grant citizenship until you've either been wounded in action or after 7 years iirc, or the case of Green Card holders like you brought up, as examples) and then uses their position as a primary method for potential substantial material gain during that service (Say, royalties for continued interviews, books, or a storefront/channel, not unlike former generals), and continues to do so throughout service of multiple nations/parties, that's technically not considered mercenary activity because it's not directly from the state (even though countries would probably be aware of how it's just a moneymaking scheme at some point)? Secondly, and the one I just thought about when reading it again, if the lack of one of these provisions is grounds for disqualification overall, which it seems to be written as, wouldn't (most of) Wagner Group not considered mercenaries since they're nationals of one of the parties to the conflict, that being the Russian Federation?

An interesting story from WWII was when the Russians invaded Poland and Finland, and later advanced into Germany they were shocked by the abundance of consumer goods compared to what the USSR had to offer.
