Money Barb Sued by Discover Bank

You never know what will happen next with the Chandlers. I mean, nothing good obviously, but you're always surprised by what does eventually happen.

I swear, if anyone shows up to the hearing...

Oh I wish. But this is pretty late notice, it would take a true semper fidelis to plan an outing right now.

Marvin had mentioned Barb getting sued in another thread, so I looked up the court record. It's filed under Greene County's civil cases. The hearing is in two days.

With spending her retirement fund on Chris getting out of jail, Chris's fines, her hoarding problem and god knows what else; this was waiting to happen

All it needed was a good punchline and I say, it's done well despite how unsurprising it was
 
I've worked with people that this has happened to. If they call the law office that filed the suit, they can pay whatever is owed (in monthly payments, if needed,) and the suit will be dropped.

The whole thing sounds a lot scarier than it actually is, if you have half a brain... Unfortunately, neither Chris nor Barb do.
 
I know they're from the same household but I almost feel sorry for Chris if he's dragged into this and misses out financially just because Barb is awful with her money. This isn't like it's something Chris and Bob turned a blind eye too, they actually tried to the limited best of their ability to get her to stop her compulsive hoarding and spending and nothing worked so Barb alone should be forced to pay for this.

It's hard to have sympathy for Barb when you hear about her going out and buying pieces of furniture that she didn't even need or end up using though. It makes Chris occasionally doing that with games seem a lot tamer in comparison
 
And considering that I don't think that the state of Virginia has a homestead exemption, if there is a lien on the house when she dies, Chris would have to pay that amount off before he was granted full possession.

Every state in the Union has a homestead exemption. Virginia just has a really shitty one, $5,000 if I'm reading it correctly. So they could probably force the sale of the home and recoup the debt from that once Barb dies.

So if that happens, we have a question to the ever-interesting what happens when Barb dies question.

(Assuming Barb doesn't properly file bankruptcy and do a proper lien avoidance.)

Well, Fingerhut is pretty goddamned close. Not payday loan predatory, but still, not exactly a reputable system of financing.

Nope. I know lots of people who owe credit card debt who got sued. Jack and shit happen.

Were those people homeowners? Did they own anything of real value? If not, they're judgement proof, and that's why nothing happened.

How likely is it that the Chandlers will end up in a situation where a bunch of Discover people walk into their home and take items of value in order to pay for the debt?

Not going to happen. First of all, they don't own anything of value, except Fatty's shiny new PS4 (as far as I can tell). Second most states have a personal property exemption that protects household goods up to a certain dollar amount.
 
Her other option would be to sell the house, and use some of the proceeds to pay this off, and you know the stubborn bitch won't do that.
Or she'll do what she's been doing, not give a shit.

Is Barb aware of her own mortality? If so she just might not give a shit because she won't be around too much longer to care.
 
I used to defend on these kind of cases pro bono for charity. They are easy and so long as one isn't a complete moron they typically end in a monthly payment plan. That is what will happen here most likely. That is assuming she turns up.

For reference, you really have to basically outright ignore your debt for a long time to get to this point.

Credit card companies and collections agencies will try everything fucking else before you're sued for the debt. Barb has literally just been disconnecting her phone and throwing letters in the trash hoping it would just go away.
That's the exact same thing both she and Bob did when they left Chris with the babysitter, "It don't exist until you acknowledge it Chrisschun, this is my own life lesson"

They're in the business of making money, they target people like Chris and Barb for a living, they also got something in return, so they're obligated, just because they have mental disorders and neurological problems does not mean anything.

Are they going to put Barb in a man's prison or a woman's prison?

If Chris makes an MLP scene, they just might put her in the chair!

Remember how Barb spent every red cent she had to not get a felony charge for 10-28-2011, even all of Bob's inheritance? She simply would not accept a guilty verdict.

I feel like the bull-headed Chandler trait will come through once more. I remember her bragging to Katherine about how she's "too smart" for the insurance agent or something. Barb might try and fight the system with this one, a battle she has no resources or even stamina for anymore.

I mean, it isn't like they have much money coming in anyway. The :tugboat: might sink under the strain of an additional monthly expense.
 
Yup. The Bank is naturally being represented by a Law Firm and those aren't cheap.

They're probably in-house counsel who get paid salary rather than racking up billable hours.

I think you're underestimating how stubborn and unreasonable Barb is and how she will absolutely refuse to do anything that would involve changing any habit she has in the slightest.

I think she'll just blow it off until the sheriff is at the door and anyone sent to try to collect it with a writ of execution or whatever is going to run back home screaming there's nothing in that home but a pile of worthless garbage. And stuff they can't collect on, like Chris's possessions.

Who knows, though? Maybe she has a stack of boxes right by the door full of shit she bought with the very card in question and has left unopened since.
