Well I'm not but I'm addressing the obvious implication that one of those five votes is necessary and it would go utterly against anything they've previously said or done. You'll note I didn't include Roberts who would be the most likely to go for a compromise vote overruling Harvard and UNC's specific plans as against the previous Grutter and Gratz opinions (which it is) while declining to abolish affirmative action in general.Ahhh newfag smell. However, they don't even need Roberts. He'd have to go some convincing. That's the only way it doesn't go down entirely.
I'd even make a side bet though that not only do they overrule it entirely, it goes 6-3 with Thomas writing the opinion. I wouldn't bet a lot on that though.
