She expects to go to the bankruptcy hearing and walk out of it with a clean slate. I guess it is possible she has been motivated enough to reach out to her trustee and start working on this. I did some reading on the Bankruptcy Canada website to find out what would happen at the hearing.
Will I Need To Go To Bankruptcy Court?
You have to complete certain duties (see below) before your bankruptcy can be discharged.
"If you don’t complete these duties, your trustee will oppose your discharge from bankruptcy in Canada, and you will be required to attend a discharge hearing in bankruptcy court. At that hearing you will be required to explain to the bankruptcy judge why you didn’t complete your duties."
I would love to be a fly on the wall when Chantal strolls in with Smee or Phyll for support, and explains why she has allowed this to linger for four years. I expect she'll give some version of "Nobody explained the requirements. to me" And I sincerely doubt the outcome of this hearing will be "Ok cool, we'll go ahead and discharge it now." I don't know anything about this process, but I predict they'll still require her to fulfill all her duties.
Perform Your Duties During Bankruptcy
The link above gives details, but here are the basics:
- Surrender your assets. (She owns nothing of value.)
- Give your credit cards to your trustee. (We know she has at least one card, and I wonder surrendering it is why it "doesn't work" anymore.)
- Attend two credit counseling sessions within the year. (It’s possible she has done online sessions, now that she is motivated)
- Provide all information necessary to file your tax returns. (She doesn't keep any records, and many of her videos have been deleted, so this could be quite difficult.)
- Make monthly payments to cover the cost of bankruptcy administration, as well as pay based on your surplus income. (She may have been set up for automatic monthly payments back in 2018, so she may be current on this. But aside from that, the idea that Chantal has been paying bankruptcy fees for four years, for no good reason, just sends me.)
Side note: This second bankruptcy will remain on her credit report for
up to 14 years. There aren't any
specific income requirements to sponsor a spouse/partner (other than "sufficient income" to support the spouse, however they calculate that), but I'm guessing they will pull her credit when she submits the sponsorship application.
Let's say she does get the bankruptcy discharched this month and her application filed in Feb. Salah could get here in about 17 months (based on the
current estimates). That isn't a lot of time in the grand scheme of things. Thinking that they can have this wrapped up for his arrival next year, is probably why Salah has put all of his chips on her.
(Although based on some of Alaa's comments, it sounds like Salah was quitting his job and selling his car, expecting to be there in weeks, not months.)
