A couple of other things to note. This is all happening in a rural area. Its a small legal community and they all know each other. They also know all the judges. The firm on the other side isn't stupid, incompetent or inexperienced. Whatever they are doing, they are doing for a calculated reason.

The guy on the other side is 28 years in the law, he is well-known in the state and he is not a strip mall lawyer by any means. Nick should think carefully about why a guy like that would even take a case like this. He also might want to re-think talking shit about that guy on the internet.
Rekieta's chemical ali routine was tired when it started, then his crony lost the Mignona case. And he talks about the law like some whiny college student, not like a serious professional. He's trying to say he's above it all and too smart to be bothered with shit like filing documents. Meanwhile when we had someone fall off a roof, it was all documents. Not too many conversations about muh principles muh free speech and the rest.
Just because other people don't whine in an effeminate voice about it doesn't mean they don't think about abstracts and ideals. Normal people, including ones much richer than Rekieta and his fwends, think about abstracts all the time. Then they end their short break and get back to earning money and getting results.
This fucking parasite isn't even funny or sad at this point, just tiresome.

Yes, I have to say I didn't realize animal fucking was a thing until I started reading KiwiFarms. Even in circles where people are out and proud about all manner of kinks (the kind of things that, just twenty years ago, people would kill themselves before being publicly exposed as involved in).

Even among those people, you still don't generally get people owning their desire to shag an animal -- let alone admitting to the actual practice. But even so, surely the numbers can't be so great as to make up the membership of the Libertarian Party -- let alone the much larger number of unaffiliated supporters. My money is still on dope fiends.
Furry Conventions do seem to get a lot of people attending...

Follow up to this, I think Nick's right in his suspicion that they've got some arrangement where monty paid them up front for some pre-arranged stuff and if this gets past the initial stages they'll re-negotiate his retainer agreement.

I think they've probably told him that they could pull these shenanigans of pocket service followed by stonewalling then filing a surprise motion for default, and if (when) that fails, he'll have to put more coins in the meter to get any further action out of them.
Remember every other time people put any trust in what this incompetent loser said about a case, and how every single time he was wrong? He can read things and explain from textbooks what they mean, everything beyond that it's like listening to some boomer slob who watches football talk about muh plays and muh touchdowns. As if they know fucking thing one.

Yes... I think they've probably agreed to charge monty X billable hours to file a complaint and a motion for default judgement, and when they don't get a default they fully expect him to drop the case when they tell him how much it'll cost to keep it going.

There is another possibility. That they are in it for reasons other than making money. That the attorney on the other side intends to milk Nick for his own purposes. It possible that he could be looking to just grab easy money from Monty, but the guy has a big rather profitable personal injury practice and it doesn't seem like Monty money would motivate him to do anything.

We will know for sure if it continues after the default judgement phase.

Or, and I know this is the least believable option for some people, this Montegraph sketch queen hired lawyers to do their job and the lawyers are doing their job.
His attorneys don't have to dance to Rekieta's tune. If he instructed them to do it by the book, that's what they are doing. No latitude no mercy.
Incredible as it is for some to believe, Rekieta comes off as a whiny annoying fuckwit to many people. It's very likely these local lawyers think he's lower than snake shit.
Which, in many ways, he is, so they got that right.

If Nick loses on default or otherwise a case this fucking retarded because he was too busy getting drunk and flirting with thirsty neglected wine aunts to pay attention it would just be the capstone on the pyramid of shit that this whole debacle has raised. Seems he already has to contend with a Judge that doesn't like him too much, if this is some bullshit play like Ty tried with the Vic case that his booze and coom addled brain came up with and he gets slapped down for it it'll be a shame but still hillarious.
People that start acting like lolcows always think they're somehow the exceptions and the shit will never get on them like everyone else, and it always ends the same way.

Especially since it's an apparent ethics violation in Minnesota.
It's in general. It's basically copy and pasted from the Model Rules (and this is one I think all 50 states have adopted).
The lawyer. He tried calling and emailing them to request an extension of time. They intentionally ignored his calls and emails and then filed for default judgement telling the court that they ignored his calls and emails and want a default judgement. Also he says they apparently haven't served any of the documents on him other than the complaint. They never served him an intent to file motion for default, never served the motion for default. They've just been ignoring him.
I think if he technically defaults but this turns out to be the case, not only will it be set aside on motion, but Monty (and his douchebag lawyer) will have earned the dislike of the court even more than it already dislikes Nick (if that is even true).

Refusing to communicate with opposing counsel (i.e. Nick, since he's currently pro se) and then filing a surprise motion for default judgement isn't "by the book," it's some underhanded shit.

The fact that they didn't serve their motion for default judgement on all parties might even be grounds to have their motion struck entirely. It's supposed to be accompanied by an affidavit of service.

Different states have different rules regarding what constitutes practice of law, or holding oneself out to be a lawyer.

If anybody wants to try and decipher Minnesota's, be my guest:

I think absolute worst case scenario is he could probably get away with Nicholas Rekieta, J.D.. They don't strip your Juris Doctorate if they strip your law license. They're legally two separate things. Notably, Mark Kern can actually use the J.D. post-nominal even though he went to work for Blizzard Entertainment after graduating law school, but before sitting for the bar exam.

This is all hypothetical right now, of course. I don't know how much in danger he is of being disbarred or suspended now or in the near future.

BTW, @TheClappening just reminded everybody over in the lawsuit thread why Rantazza might be ghosting Rekieta, or otherwise less than enthused with Rekieta's plan to grift this thing.

I also re-dug up this:

I'm sure Nick regrets little from Weebwars, but it's quite possible he regrets this particular spat now.

It is really hard to get disbarred as an attorney. Minnesota isn't so monolithically Democratic they'd risk this against an activist lawyer for using the word faggot on the web; especially given the 1st amendment implication. The bar is a state agency charged with the licensure of legal professionals. They need a reason and him calling some one a fag isn't one that would work without massive heat. No one wants that shit to go after an e-grifter. Added to that, after looking over some instances, they all looked to me be about clients and money or crazy attorneys with drugs and crimes.

The ethical, as I understand it, line Nick skirts is he has, Weeb Warz being the best example, pretty much provided legal advice. He was pimping that case out, selling its merits and had an intimate ongoing relationship with both Vic Minoga and the loser he recommended to Vic.

Minnesota bar also has the added weirdness of being run by the state, so first ammendment stuff gets a lot harrier.

Addendum/correction: according to the affidavit of service, they served it by US mail to his old address.

This is the worst sort of gamesmanship and no judge is going to be impressed by this in the least.

Wait, they're also in Willmar? Do they have some kind of personal thing with Nick? Because this is pretty personal scumfuck type behavior.

Also, who the bigger fool, the lying narcissist Rekieta or the simps who tie themselves up in knots explaining away his blatant lies?
It's one of the strangest things about e-cancer and their simps, how the simps explain away shit like this.
Really is cult-like. Same mental defect / quirk
People can play pretend all they want to protect their e daddy not my problem. Just point and laugh man.

One lolcow suing another? CHECK
Lawsuit is really a lolsuit about saying mean things on the internet? CHECK
Both sides fucking up procedurally from the very beginning? CHECK
Like how Nick got his start with Maddox's suit, it might be a good chance for someone new to capture a part of his original law-interested audience by going through the documents and procedural shenanigans of this one (if it survives). Nick was probably intending to do this himself, but would that be wise if he's already not in a great position?
