The Mexican migrant shot dead by an Arizona rancher after crossing the border illegally and running onto his land can be pictured today for the first time as his family calls for 'justice' in his death.

Gabriel Cuen-Butimea, 48, was shot on Monday January 30th by 73-year-old rancher George Alan Kelly, after crossing onto Kelly's land in Kino Springs, a remote area of Arizona just 1.5miles from the border.

He was unarmed and was shot once - dying on the property.

Kelly, who friends say has had trouble with other migrants passing through his land, remains in custody in Arizona on a $1million bond, awaiting his next court appearance on a single murder charge.

He pleaded with a judge to lower it or set him free earlier this week, citing the fact that his elderly wife couldn't tend to their livestock alone, but he was sent back to jail.

Cuen-Butimea tried multiple times to enter the US illegally before Kelly shot him dead.

Records indicate he was deported several times, most recently in 2016.

It's unclear if he ever crossed the border onto Kelly's property before the incident on Monday.

Sheriffs say they did not know each other.

Many of the details of the case remain unclear, including whether Kelly will be able to invoke a stand your ground defense.

As Kelly awaits his next court appearance, Cuen-Butimea's family in Mexico are mourning his death and demanding justice.

On social media, his relatives are calling for justice.

'We will get justice for you, daddy, I promise,' his adult daughter said alongside Kelly's mugshot.

The family has not explained why Cuen-Butimea had crossed over into Kelly's land.

In court yesterday, Kelly begged to have his $1milion bond lowered.

'She's there by herself... nobody to take care of her, the livestock or the ranch.

'And I'm not going anywhere. I can't come up with a million dollars.

'Would you consider reducing it to any degree?' he said.

The judge, Justice of the Peace Emilio Velasquez, told him his lawyer would have to file a request to lower bond.

Kelly was appointed local public defender Brenna Larkin, who is yet to answer any media inquiry about the case.

Arizona's Stand Your Ground laws​


Under Arizona law, 'a person is justified in threatening or using physical force against another when, and to the extent a reasonable person would believe that physical force is immediately necessary to protect himself against the other's use or attempted use of unlawful physical force.'
It could be used as a defense when homeowners attack — or potentially even kill — someone to stop certain crimes like murder, rape or armed robbery.
The Stand Your Ground laws are not permitted as a defense, however, when there was only a verbal provocation or the homeowner who is claiming self-defense provoked the attack.
By using the Stand Your Ground laws as a defense, prosecutors have to prove beyond a reasonable doubt that a defendant was not justified in using deadly force in self-defense.

Pretty much only Texas has a defense of property law on the books, and Castle Doctrine only applies to a regularly occupied dwelling or vehicle... meaning even a barn wouldn't count.

Texas also has purple paint laws (a vocal telling that trespassers are not welcome and are risking their personal safety if they cross into the protected area).

Now, Arizona apparently is a state with Purple Paint Laws as well so if the rancher might be saved if he took precautions into this. If not then he fucked up because the entire purpose of the law is to basically convey NO TRESPASSING IF YOU LIKE LIVING. Beaner judge probably wants to throw the book at him and give the family a bunch of money so they too can come over to be dregs of society.

That he was a repeat offender should merit the death penalty right there. Corporal punishment for the 1st offense, then capital for all successive offenses. Then the problem goes away. How simple.

George was returning to the ranch with some salt blocks and he as was opening the north gate when he saw two riders moving across his ranch towards the Mexican Border. He jumped back into his pickup and sped south like a bat out of Hell. He had to stop the truck about four hundred yards from the Border and hoof it south, AK-47 in hand. When he got to the top of the first ridge and looked south he could that one of the horses being ridden was Sonny. The riders were less than one hundred yards north of the Border and riding full out. He emptied a clip as close to the horses as he could without hitting them, the horses that is. The riders pulled up at the Border, jumped off and started returning fire. Then they started cutting the ranch fence. George flipped the duct taped clip over and began firing the second thirty round clip, aiming directly at the riders themselves. One of the riders suddenly jumped to the right, holding his arm. The horse he was holding bolted and ran back north. The fence was cut and the other rider remounted, pulled his cohort up behind him and then he whipped Sonny across the Border. George had emptied both clips but he ran towards the cut fence with his Glock drawn and ready to fire. When he got to the fence he could still see the two riders whipping Sonny two hundred yards to the south. He kept his binoculars on Sonny for as long as he could, but he soon lost sight of his horse as he faded away, heading deeper into Mexico.
He's an author. This probably won't help him much. Hopefully book sales can help with his legal defense.

“It’s really important to understand that when you’re seeing individuals and you’re placing a bond, you have to go ahead and look at what kind of crime has been committed,” Velasquez said, adding that probation officers provide an assessment that includes a defendant’s criminal history.
“One of the most important things in these bonds is that they are not a danger to society. If they don’t fall under those categories, you release them and make sure that once they come in they’re set with pretrial services to make sure that there’s connection between them and the agency.”
That is the guy who determined 75 year old farmer was a danger to society.


She says it’s not unusual to see people who have crossed the border coming and going around the area but she says none have caued any major issues.

“Nogales is known as one of the tunnel capitals in the United States,” Brinkhoff said. “There’s been 230 hand-dug, cross-border tunnels in the United States of America. 118 of them have been right here in Nogales. One mile to the east and one mile to the west is where all of them have been.”
No major issues, just lots of violence and drug activity. Nothing to worry about.

This is why you dont call the cops in this case and just dispose of the body, farmers should have access to chemicals, tools and animals to get the job done. Realistically no one should come looking for him.

That aside, this is an example as to why shooting blanks as a way of deterrence should be a thing. Or better border security. That too.
If you are going to shoot, shoot to kill. Courts frown on warning shots and I don't think they would be too kind to using blanks either.
