The Mexican migrant shot dead by an Arizona rancher after crossing the border illegally and running onto his land can be pictured today for the first time as his family calls for 'justice' in his death.

Gabriel Cuen-Butimea, 48, was shot on Monday January 30th by 73-year-old rancher George Alan Kelly, after crossing onto Kelly's land in Kino Springs, a remote area of Arizona just 1.5miles from the border.

He was unarmed and was shot once - dying on the property.

Kelly, who friends say has had trouble with other migrants passing through his land, remains in custody in Arizona on a $1million bond, awaiting his next court appearance on a single murder charge.

He pleaded with a judge to lower it or set him free earlier this week, citing the fact that his elderly wife couldn't tend to their livestock alone, but he was sent back to jail.

Cuen-Butimea tried multiple times to enter the US illegally before Kelly shot him dead.

Records indicate he was deported several times, most recently in 2016.

It's unclear if he ever crossed the border onto Kelly's property before the incident on Monday.

Sheriffs say they did not know each other.

Many of the details of the case remain unclear, including whether Kelly will be able to invoke a stand your ground defense.

As Kelly awaits his next court appearance, Cuen-Butimea's family in Mexico are mourning his death and demanding justice.

On social media, his relatives are calling for justice.

'We will get justice for you, daddy, I promise,' his adult daughter said alongside Kelly's mugshot.

The family has not explained why Cuen-Butimea had crossed over into Kelly's land.

In court yesterday, Kelly begged to have his $1milion bond lowered.

'She's there by herself... nobody to take care of her, the livestock or the ranch.

'And I'm not going anywhere. I can't come up with a million dollars.

'Would you consider reducing it to any degree?' he said.

The judge, Justice of the Peace Emilio Velasquez, told him his lawyer would have to file a request to lower bond.

Kelly was appointed local public defender Brenna Larkin, who is yet to answer any media inquiry about the case.

Arizona's Stand Your Ground laws​


Under Arizona law, 'a person is justified in threatening or using physical force against another when, and to the extent a reasonable person would believe that physical force is immediately necessary to protect himself against the other's use or attempted use of unlawful physical force.'
It could be used as a defense when homeowners attack — or potentially even kill — someone to stop certain crimes like murder, rape or armed robbery.
The Stand Your Ground laws are not permitted as a defense, however, when there was only a verbal provocation or the homeowner who is claiming self-defense provoked the attack.
By using the Stand Your Ground laws as a defense, prosecutors have to prove beyond a reasonable doubt that a defendant was not justified in using deadly force in self-defense.

What's funny is that the US is one of the few nations that has it. Other nations like Japan require a Japanese parent or relinquishing of previous citizenship.

I don't feel any pity for boomer rancher. This guy wanted to live out the life of shooting illegal immigrants on the border so badly that he wrote a self-insert novella about it. He was itching to instigate a conflict where he could legally shoot a man. I can't feel bad for the fifth timer illegal immigrant either but there's nothing heroic about what Kelly did. The situation he put himself in was entirely of his own creation and he probably told the police lots of things that will be used against him in a court of law.

Good lord I wish we would put up land mines, run some F-16's overhead every day with some 250lb GBU's for target practice against those pickups they use to guard the convoys. Do that for a month, shit like this wouldn't happen. The cartels would never come back.

So, they're trying to paint a humble old man as a villain while deifying an old, alcoholic rapist, who was probably a drunk driver. He was standing his ground. Fuck the judge.
 
Remember a couple of years back the illegal who had been discovered to be a serial child rapist? It was somewhere on the East Coast, like Pennsylvania or Massachusetts or something. The guy was also a serial border jumper and had been deported several times for similar behavior, but because he was in a sanctuary state it was seriously difficult to get him shipped out again. How I wish that the government would declare the whole southern border as a massive gunnery range for A-10s, F-16s, and Mudhens.
 
If you're a non-latino white there's absolutely no good reason to keep living around the southern borders. Cut your losses and run, and let the human waves of illegal immigrants be contained there. The law seemingly doesn't apply to them, they can do whatever they want to you and your property, you can't defend yourself in any way, and if you complain about it, you'll be crucified by the media while the government laughs at you. Just get out of there and find greener pastures. With all of that said, from the other comments it does sound like this story's a little more complicated than it seems, and while the boomer may've been justified in shooting a trespasser, he may also be kind of a murder-fantasizing weirdo himself.
 
The amount of red tape one has to go through in order to legally migrate to the US from non spic countries (especially Euro countries) is insane. They literally penalize you for saying ‘hey, I want to work, pay taxes, and be a productive member of society who learns your language and adjusts to your culture’. Meanwhile beaners just prance across the border and leech of of American taxpayers, setting up their own beaner towns, and the government couldn’t be arsed to do diddly. That’s not even touching on the demographics issue.
