The SLAAP part has a high bar and burden of proof required: ostensibly he's already demonstrated prema facia that Klein not only slandered/libeled him, but did so with actual malice. This is usually extremely difficult to prove at the best of times, but the case now proceeds with this as a established factual element of the case, so the case now will just be establishing damages.

From reading through the article that was posted here, Klein lost because he had left a bread trail of encouring his fans, employers etc to write false shit about this dude.
His big mouth on his podcast has not help either, as Kavanaugh could point to that and say "look, Klein is knowling spreading false information about me" .
I don't think he is going to get a lot of support this time, because he has become such a fucking cunt, that nobody want to be near him.
I know it's a common joke in the legal board, but this is another case where I wish both sides could lose.

I erroneously featured this stating that Klein was suing Kavanaugh. He is not. Klein bought a domain asking if Kavanaugh looks like Harvey Weinstein. Kavanaugh is suing for damages, I believe for defamation. The California anti-SLAPP statute (which is similar to the one in Texas brought down Vic's lawsuit) is very strong, but Kavanaugh has met the burden of evidence to proceed. Klein is now in an expensive phase of proceedings where he must actually argue the facts of the case, and is on the hook for a lot of money.
