I come bearing gifts: Translation and Kuwaiti family laywer legal opinion on misyar marriage.
OK,
first, I just had my husband (kuwaiti, so speaks arabic ) Translate the Aala Murad vid for me, especially the misyar part. Farida is NOT wrong, he also heard murad say they got a misyar marriage ( the type of temporary marriage ) that lasts
5 to 6 days ( he understood it to mean the temp marriage was of the duration of 5-6 days) married by sheikh Abu Ahmed , who is says is on twitter, I did a quick twitter search in arabic , but if he is really there by that name, it'd need major sleuth capabilities to find.
Secondly, we called a friend who is a kuwaiti family laywer and he said:
Misyar is not recognized in Kuwait, so anything they did has zero legal weight to it.
They cannot sue the court to get something recognized that is not legal.
You cannot transform a misyar marriage into a normal one, you just have to marry again the legal way.
In some rare cases, mostly involving military kuwaiti men who have an informal Nikka to a non kuwaiti wife because the army does not give them permission to marry non kuwaitis but many fall in love during officer training abroad etc. ( so , its the same exact type of marriage, a real islamic marriage not temporary but just not legal in the civil sense) the court can be sued to get the nikka made legal they'd just get it on the spot, there is no" getting the contract by such and such a date" like they are saying.
The other case he said its done is when a child is born out of legal marriage but in Islamic marriage
and you want that child recognized legally.
Lawyer friend said in his opinion they are not legally married , he said its simple , misyar is not legally recognized, you can't transform it into a legal marriage, and when it comes to marriage there is not " ongoing process",
" show me the contract " he said , no contract, no marriage.
So this still leaves lots of questions : 5-6 days temporary marriage ? What on earth are they doing in the court? probably trying to get an exception of some kind, but IF ( big if) they did, they'd get the legal contract on the spot, not have to wait for it.
My take: either its all lies on top of lies they are all involved in, Or they are lying to her and Chantal believes they are just waiting for the contract.
If by any miracle they produce a marriage contract at some point, it's been obtained shadily unless she is in actual legal employment and working (not just a ghost job) and has a civil ID of her own. I think they will try, have tried, to get her under their soap/perfume companies name, and that's very dangerous for them both because its visa trafficking, carries a very hefty fine and jail time or deportation.
Last point: Whether their misyar marriage is/was a valid marriage
in the eyes of islam or not depends on what school of thought you adhere to, some jurists/scholars view it as ok, but others reject such forms of marriage totally.
