In the 4 or 5 or so years since, he's probably spent less than the equivalent (generously) of a year's worth of actual practice. He is neither legal scholar nor experienced tactician.

The fact that Baker's also not constantly drunk on-air or talking about her favorite sex toys, or politi-sperging, are additional factors, but even if he had decent judgment about presenting himself, he has nothing to bring intellectually or experientially to a legal topic. He would never be in a similar spot.

At this point, Nick is a lawyer in name only. It's clear he lacks the chops and motivation to practice, let alone act properly during an ongoing trial where he's involved. He lacks any sort of professionalism as we have seen to maintain respectable image. At this rate Melinda Scott is going to have done more work doing legal stuff even though all her submissions were spurious.

This is why I have a hard time watching Emily compared to Rackets. Her live chat is very similar to Nick's Locals chat, with the only difference being that her mods wrangle people who openly fight. This creates a weird tension where everyone is ready to lash out at the dissenters, but can't do it directly, so they scream passive aggressive remarks into the void.

Emily is nice, and knowledgeable on the prosecutorial perspective, but she's still human. She forms preconceived notions and tries to rationalize contrary evidence, which makes the Murdaugh trial in particular difficult to watch. In contrast, Nick has a panel that can all throw together their own ideas (namely, Joe likes to play Devil's Advocate). They also help prevent Nick from making constant sex jokes, by keeping him on topic.

This is why, even with the drama, I prefer Nick's trial stream. With Depp, Emily and Nick were equally entertaining. With Murdaugh, Emily's hugbox and biases are much more apparent and annoying.
 
So either Montegraph is being defamed just like Vic was (and will lose like him) or what Monica and whales were doing was in fact not defamation. Definitely an interesting conundrum.
Isn’t the difference that Vic had a reputation & career that suffered real damages vs Montegraph who has neither? It would be “failure to state a claim upon which relief can be granted” because how can Montegraph prove that anything Nick has said has caused him to loose X dollars of income, etc.

He didn't hire Randazza because he was the best lawyer for the case or because he was a specialist. He hired Randazza because Randazza is his hero, and he wanted an excuse to talk to him. Let's break it down:
  • Nick sees himself as above ethics rules, and so does Randazza. Randazza's license has been suspended in 4 different states. Nick has only gotten close to getting in trouble in one state.
  • Both of them also see themselves as "exceptional" when it comes to conventional wisdom. Both have gone out in public to comment on their case before it has even started. There's a reason that everyone from the local meth dealer to Martha Steward gets the advice to STFU about their case.
  • Nick is a noted swinger and coomer. Randazza is an ex porn producer before pivoting into porn law, and eventually trying to go legit as a first amendment lawyer. He was the ultimate coomer - he needed to coom so hard that he made his own material.
  • Randazza is known for being a first amendment lawyer primarily due to his work on the law around porn. He is an actual "libertarian justice warrior" (really, a libertine justice warrior). Nick desperately wishes to stand up to "the man" for personal liberty in the same way. Nick reveres Randazza the same way he reveres the guy who made the killdozer.
  • Nick is a terminal clout chaser. A small town lawyer, or even a real defamation specialist, would not be able to give him the clout he wants, he needs someone with a media presence that is bigger and more legit than his.

You know now that I think about it, Null's theory on smugness being your downfall is pretty on point here with Nick. His reaction to this lawsuit and his general demeanor just exuded smugness. It's easy to want to see him fail, even if only to humble him somewhat.

I don't want to see the guy financially ruined but a good bloody nose, especially after how his friend fucked up the Vic case is in order if you ask me.
