Like, it was legislation put in by Obama some years before Trump was in office, but those systems were somehow not installed after that legislation was put in place, and were not installed until 2017 or so, allowing them to then just never install them? Making it Trump's fault that brakes didn't stop the train from derailing (supposedly), when Biden didn't immediately reverse Trump's legislation when he got in office?
So, were the brake systems never installed, despite the Obama Era legislation because that legislation was lax enough to allow for a loophole?
Or were they installed, and then removed after a few years? Why do that when the complaint from the rail companies was the cost of installation/buying the systems to begin with?
Were these trains not used during the years the Obama legislation was still a thing? Is that why it was poorly maintained enough to catch fire? Or were they built after? Then why again, did it catch fire?

This is actually very important and very likely for one big reason. It gives the judge an out. They managed to get the first and second in a form McCarthy couldn't weasel out of and I said at the time that it would be a matter of time before we knew if they were serious. Thankfully, they are, so the third is also in place and McCarthy is their bitch.
Though now we need to wait with bated breath to see if they fall into the final pitfall. We need to see if they overplay their hand. The worst thing that is true is they should ask for nothing else until after the next election. If they push too hard too fast it increasingly risks McCarthy going 'fuck it' and deciding that it's not worth the fight and flouncing out to let a Democrat take his seat. Instead, what needs to happen is in every election the pressure resumes. A new series of concessions, drag McCarthy kicking and screaming closer to the FC every election cycle when the FC is at its strongest politically and McCarthy has the tantalizing possibility of power in his grasp.

Companies do not want to do it. "Muh costs" "muh profits" "wah wah let us be oligopolies in peace". So they spend the 2016 election donating more to GOP than DNC.
Trump wins in 2016. As do a bunch of Rs. They use their donations to lobby Trump and his admin. They then undo the legislation, meaning they never have to bother as the law will not go into effect.
As a side not, the whole thing of blaming the brakes is quite honestly a complete cope and complete speculation. The train wouldn't have even had the ECP brakes even if Trump had not canceled the legislation (the OG laws would have required them on trains with dangerous cargo, but the Rail lobby have very expensive jewish lawyers to game the system so the trains like the one in East Palestine are officially not dangerous cargo because only sometyhing like 50% of wagons had chemicals so it was officially "Mixed Cargo"). Furthermore info we have atm says the train was showing problems as far as 20 miles before it derailed, with a wheel on fire.
