Abuse is tortious when it causes Damages the victim can recover through civil action. In Canada that includes compensatory(general/special damages) and non-compensatory(punative, nominal, etc.) Damages that are awarded to make the victim whole again before the Tort occured, and at the discretion of the Court. I'm not gonna sperg on different damages types this isn't Torts 101 but a fucking Cat can't bring a tort claim against the Owner who abused it. If the OSPCA had to seize the Cat the Owner of the Cat could be charged civilly to recover the cost of care(along with any seperate criminal charges that might be brought). If you lend a stud dog for breeding and the Breeder maims the dog the owner can sue for the reduced value of the stud dog. Etc.
Who ever has the BBJ now can't sue for the cost of treating the results of the abuse because they accepted one as-is condition Cat with disclosure of bad claws/feet. There's no tort there since it's not like they were promised a 3 year old show quality nebelung Cat and ended up with BBJ.
Survivors of domestic violence and childhood abuse can sue successfully for damages against the Tortfeasor in Ontario like any other plantiff with damages, but a
Cat can't sue to be made whole.

laymen's Definitions aren't the same thing? You can't civilly agrieve a cat. You can the cat's Owner. The cat can cause/inccur costs the Owner is responsible for. The Cat is a Cat. The people of Leafland and Ontario decided to criminalise abuse and neglect to the point of suffering so the abuse of the Cat can be a crime by the Harbourer/Owner of the animal, or the abuser or the anima- but the Cat isn't suddenly a civil plantiff. It is a Cat.
