You chuckle to yourself and then continue on with them to the next topic, completely trusting their opinions and expertise despite them having just proven they are full of shit.

I, perhaps to my entertainment detriment, have zero patience for this. I try to turn it off when I can but I find it difficult. The reason I stopped listening to The Behavior Panel, for instance, was because in one video they were talking about Scuba Diving with such confidence and got so many things very wrong about it and it just spoiled my care for their opinion.

It really is at the core of Nick's credibility issues though. Most of us gave him the benefit of the doubt for a long time that he knew what he was talking about when it came to the law and even if he was wrong it was because the law is complicated and shit sometimes doesn't pan out the way it should. The more he deviated from legal topics though, and especially with such confidence/stubbornness, the more he exposed how fucking dumb he was. Each time he jumps into a topic he is ill-prepared for he is going to expose this to more and more demographics and this time it is the VTuber community. The real issue isn't even him being wrong. Wasn't his last case just pleading guilty and trying to get a reduced sentence? I don't have the clip to hand so maybe my memory is fuzzy, but his issue was that the judge brought up that the client had private counsel rather than a public defender in a case about embezzlement. The judge specifically brought it up in the sentencing hearing, the part where they are listing all the reasons the judge went up or down the sentencing framework. Since someone has the right to an attorney it can be considered inappropriate to do so. According to Nick he did the case pro bono so the judges claim, according to Nick, that the embezzled funds had in part paid for counsel where doubly inappropriate.

Thing is, Nick has come off as so thin skinned that I can believe he was just pissy about not getting the reduced sentence.
To give the Balldo man his due, it is inappropriate for a judge to use the existence of private counsel against a defendant.
It is also just professionally dumb to drunkenly bitch about it on your internet show. Why burn bridges?

I am the same way to the point that I tried to relax and narrow down to why I listen to people, so a body language panel can say dumb shit about something I know more about, but I don't expect them to know anything definitive about it. Those articles by journos that are full of shit often fill people with unwarranted confidence.

For example, most science/engineering YouTubers/Creators have diametrically opposed politics to me and I find there knowledge of "the other side" very lacking when they comment on politics. I just accepted that they don't know anything about politics and I don't watch them for political takes. But, if they start getting science/engineering shit wrong without retraction/corrections then I stop listening.

Not quite. He shot for no custodial sentence at all, which was just not going to happen even for a white collar crime, considering the severity of the offense and the harm to the multiple victims. I don't know if the prosecutor wasn't willing to negotiate or Nick was too much of a buffoon to negotiate effectively, but thinking he'd get no custodial sentence at all was crackbrained.

That said, had there been an appeal, the judge actually using the fact she had counsel as a reason for enhancing the sentence (or even just mentioning it at all) was incredibly improper. That would probably have got at least an admonition from an appeals court even if they upheld the sentence, which was reasonable I believe under a totality of the circumstances. His client was a real scumbag who ruined a lot of people's lives.

In general, appeals of a sentence in Minnesota are subject to a very difficult to meet abuse of discretion standard, while if it involves the interpretation of the Sentencing Guidelines, it is de novo (i.e. they can overturn it if they just disagree with it). I'm not sure if this case involved an upward deviation from the Guidelines, but at the very least, it was on the high end.

We have been given zero new information about Nick other than what we see. I've brought no inside information that's moved anything forward. I'm willing to bet Faran knows a whole lot more than what we saw in her texts. If she had a vendetta, we would have seen and heard it by now. She also hasn't been online since March with little to nothing heard about her since.

I get the idea of her being me makes for a great sexy story: "Former friend turned detractor and vents on kiwi." Unfortunately it's not the case. I do find it funny that out of all the Nick orbiters, she spent the least amount of time with Nick, yet gets the most amount of attention on this thread still, minus the text message. Just my opinion. I get some still think I'm Faran. This will be the last time I address it or say it......... wish I was, but I'm not Faran. I'm not even fat................... my BMI is below 15%.
