Even with my very limited following of the case, it's laughable to state that there isn't genuine issues of material fact about the claims alleged. With no discovery and not nearly enough undisputed facts (if any aside from Nick saying the allegedly defamatory statements) for a judge to grant it, this felt like pissing away money.
So far as I know, not even Nick has the bodacious gall to claim Monty actually does suck little boys' dicks.

At this point, a real man would admit he fucked up and try to settle for an apology and maybe pay off Monty's fees.

But Nick isn't that.

He didn't get to real discovery, and he only got to depositions for the limited purposes of the SLAPP motion. And the only reason he even got that was that the defendants got their deposition of him. So far as I know that's not a rule but we were operating under Chupp Law.

It's just about too late to pull up it seems. Rekieta has ignored all the well meaning advice from people who genuinely wanted him to succeed in favor of ass kisses.

I know there's a time and place for not taking your own advice; but Nick should've taken his own (lawyerly) advice and shut the fuck up about ongoing court proceedings. I mean, that is a thing right? You're going through shit, people ask questions, and you say you can't talk about it because it's ongoing.

ts probably worth saying now that IMO Nick's attorney, for all his reputation and all the money Nick paid him, did a remarkably bad job in all this. They went for an unlikely home-run argument about colorado law, they went off into the weeds writing a massive biography of Monty in their filings rather than focusing on basic legal arguments. They spent a whole lot of money on those filings and at this point have gotten nothing for it.

Suggesting that the judge denied the motion because it was "premature" is delusional.
In fairness the judge did use the word "premature" several times.

A Ctrl+F search of the document reveals she used the word "premature" 4 times.

All four of those occurrences involved Monty's emotional distress claim.

My read of the ruling is that the judge does legitimately appear inclined to dismiss the emotional distress claim at this time, unless Monty can demonstrate some evidence of damages associated with that, which TBH I don't see happening.

There is still the defamation claim and there I'm not so sure about whether Rekieta is poised to prevail on that (for the reasons @Strix454 later discusses). On the positive side for Nick, the judge appeared to agree (at the start of page 4) that both parties constitute public figures.
