He attempted to say that the Minnesota State Constitution allowed Colorado's anti-SLAPP law because applying it would be just like a summary judgement determination under minnesota law in cases that are "shams" or "frivolous".

He also attempted a very dubious argument that Colorado's anti-SLAPP law requires NO weighing of conflicting evidence by a judge in making the anti-SLAPP ruling. He was claiming that in making an anti-SLAPP ruling under Colorado law, that the judge was making no decision at all and not stepping into the jury's role at all.

IMO, it was a bad argument in that if his argument was valid, anti-SLAPP legislation would be constitutional in Minnesota. That the Minnesota state legislature could pass Colorado's anti-SLAPP law with no constitutional hurdles in the minnesota state courts. But that is absurd. The Colorado law would not survive the supreme court ruling's reasoning any better than the Minnesota law did. Which is why the state legislature made no further attempts after the decision.

And in making the claim that asking for anti-SLAPP was just like asking for a summary judgement, he (IMO) undermined his motion to dismiss. By making that argument, he is asking legally for a summary judgement which as the ruling made clear has implications.

He pointed to a reasonable inconsistency in the Minnesota Supreme Court decision in that the decision perhaps didn't establish an absolute well-defined standard for when decisions by judges violate the right to jury trial, but its not a useful inconsistency in this case.

I'm pretty sure that it'll ultimately be a decision for the jury, not for the judge. I thought that the judge said as much in her recent decision? IIRC, she said that calling somebody a paedo is defamatory per se under Minnesota law, and if Rekieta had what he believed to be a defence, that that would be a triable matter of fact that would have to be decided by the jury.
