The suspect shot the girl in the head, he was then tackled by the girl's father and as they were in the scuffle the gun the suspect was carrying discharged and somehow he was struck in the eye by it.

I'm guessing the gun recoiled during the struggle and the handle happened to hit him in the eye somehow, as a bullet would probably have made a more terminal wound. Can't say I'd have blamed the father for picking it up and blowing the guy's head off in that situation.
