The judge made a comment in the ruling though which one could infer that they are public figures. But my opinion is that its premature to read too much into that sentence and I would also say that even if Nick is a public figure, he is far from safe. He has provided quite a bit of evidence as to his motives. More than one could usually obtain in a lawsuit like this.

Nick's comments were not opinion. He made a statement of fact himself about Monty. That is why he is in trouble. He said that Monty is actively committing what are crimes against children.

BTW, I finally checked out the OP. @mindlessobserver did a good job but there are a couple of glaring errors.

First, Nick’s law firm wasn’t what provided a comfortable life for his family: His parents’ and grandparents’ trust funds did that.
