I suck at searching, a couple weeks back Jersh had a video of some protest (I think Chloe Cole was there) where some trans activist was saying "this never happens" (meaning medical transition of children), the other guy pulls up a video that shows that it is, and then the TRA pops back of course it's happening, it's a good thing these kids are getting the care they need.

Does anyone have a direct link to that video?

It is with deep sadness that Good Shepherd Ministries, International (http://isom.org) announces that its efforts to reasonably settle its ISOM trademark dispute with Mr. Eric July and his business Rippaverse LLC have been unsuccessful. Good Shepherd had hoped to avoid the time, effort, expense, and uncertainty associated with litigation, but settlement negotiations have reached an impasse.

Good Shepherd will now serve its lawsuit on Mr. July’s company, and seek relief in court. With the serving of this lawsuit, all previous settlement offers are off the table. Good Shepherd intends to defend, with everything it has, its good ISOM name. We created that name over 25 years ago and have grown it prolifically, on a global scale, in the ensuing decades. We are at peace knowing that we tried hard to resolve this out of court through a simple settlement. Even though we failed, we are confident that a jury trial and the legal system will bring a just resolution to this matter.

Some related information is set forth below:
The CORE issue in this dispute is Trademark infringement. A basic test for trademark infringement is whether consumers are likely to be confused as to the source of the trademarked things – in other words, are consumers likely to think there is a connection between (1) Good Shepherd’s decades of using its ISOM trademark and Good Shepherd’s U.S. Registration of its ISOM trademark, and (2) Mr. July and his company starting a little over a year ago to use ISOM as the name of a graphic serial novel character. As mentioned below, we already are far past a “likelihood of confusion.” We have evidence that Mr. July and his company have caused actual confusion.

Mr. July and his company used our ISOM trademark as a character name and title to launch their Rippaverse company. They found a receptive audience, and every month their infringing use of our ISOM Trademark has been increasing. This is being accomplished through search engine optimization (SEO), social media posts, and other online postings that highlight our trademarked ISOM name. As a result, their infringement of our ISOM Trademark is now at a point where it is colliding with our customers and our organizational use and cannot be ignored. The recent lawsuit controversy over their infringement has only amplified everything and resulted in extensive coverage of ISOM on podcasts, blogs, vlogs, X, and YouTube channels. These are only adding to the confusion.

Here are some of the many reasons for the likely and actual confusion:

· Both organizations spell the ISOM name in the exact same way
· As a result, Internet searches of the word ISOM bring up both organizations and products side by side. Under “images” and on YouTube this confusion is amplified
· Social media hashtags including “ISOM” are similarly confusing especially #ISOM
· Both organizations pronounce the ISOM name in the exact same way
· Both organizations are engaged in the online sales of publishing content
· Both organizations have products that have a Christian theme or mark (i.e., Mr. July included a cross on his character’s belt)
· Both organizations have overlapping conservative Christian audiences
· Both organizations are involved in charity work
· Both organizations have merch products that look very similar

As mentioned above, Mr. July’s use of ISOM is not just “likely” to cause confusion – already we have come across many examples of people actually being confused as to whether we are the source of, or associated with, Mr. July’s comic book/character. The damage to our ISOM name is obvious. Here is just one very recent (October 2023) example of such actual confusion.

I apologize for such a strange email, but I just recently saw a You Tube video my son was watching, and I saw something that genuinely concerned me regarding ISOM. I may have misunderstood, but from what I understand a man representing your brand stole money from children in need, and frankly I find that unacceptable.

I certainly don't blame you or ISOM for associating with such a man, as he may not (and hopefully does not) reflect the values of ISOM, but I don't think my worry is unfounded. I myself am a devout Christian, and to see someone abuse the faith in such a manner is abhorrent.

Firstly, I'd like to apologize for my accusatory email. I was certainly mistaken, and for that I sincerely apologize.

I only somewhat knew of the ISOM program from a little over a year ago, where after I retired I was able to focus more on my religion. I have been looking through different programs to advance my connection with the Lord; ISOM being one of the main programs I was looking into.

I just felt the need to reach out to ensure that the faith wasn't being used for frankly despicable purposes, at least if I understood the video I overheard correctly. I learned a little more about the controversy from my son, and I learned after that there was no connection between the two.

Regardless of the validity of the accusations contained in the above emails, it is easy to see how Good Shepherd can get discredited by every controversy generated or faced by Mr. July and his ISOM comic book brand.

Good Shepherd is a Christian ministry. It is 100% a 501(c)(3) nonprofit that is significantly sustained through donations. These donations depend massively on public trust and financial and organisational integrity. The damage to our charity’s reputation by Mr. July’s use of our Trademarked ISOM name is extremely real and significant.

As mentioned above, at great expense and effort, Good Shepherd adopted and has used for decades our name “ISOM.” That is how we are referred to all over the world. This is no different than other organizations like IHOP, IBM and KFC whose branding has become their trademarked letters. The one-minute video below is on our http://isom.org homepage and clearly shows the use of our ISOM name and the scope of projects we are involved with UNDER our ISOM name all over the world:


Mr. July is not shy about his personally held beliefs and has a significant audience, especially on YouTube. While he is certainly entitled to his own beliefs, we do not want his beliefs, statements, and actions to be wrongly attributed to Good Shepherd because of Mr. July’s use of our registered trademark ISOM. Specifically, and among other things, Good Shepherd is concerned about Mr. July's prolific use of unacceptable swear words. Being associated with that usage is deeply troubling to us, and even more disturbing is when Mr. July uses the name of Jesus Christ in vain. This is, to us, completely unacceptable for someone claiming to represent the Christian faith. We have gathered evidence of these unacceptable verbal usages and our board of directors does NOT want our ISOM brand to be confused with, or associated with, Mr. July or his ISOM brand.

In short, some of Mr. July’s public statements, actions, and persona do not reflect Good Shepherd’s core values or ways of communicating our values.

For these reasons, and many more, we are serving our lawsuit. Despite our efforts, Mr. July and his company refuse to acknowledge that they have, in any way, infringed on our ISOM Trademark rights. This infringement matter is central to everything else. Unfortunately, it appears, the legal system is needed to resolve this core issue. Only after Trademark infringement has been confirmed can any further negotiation be meaningful.

Family of man wanted for killing Josh Kruger says the 19-year-old and the journalist shared sex and drugs​


The family of Robert Davis, 19, who is accused of killing local journalist Josh Kruger, said that Davis was just 15 when he and Kruger began a years-long relationship involving drugs — and that Davis told them Kruger was threatening to post sexually explicit videos of him online before, police say, Davis shot Kruger.

Those assertions by Davis’ mother and older brother in recent interviews with The Inquirer add troubling new complexities to a killing that has garnered national attention. Their account, they said, is drawn from recent conversations with Davis, and from the years of watching his life unravel as he tried to keep the relationship and his drug addiction hidden.

Kruger, 39, was killed after a man entered his Point Breeze home in the middle of the night, police said, and shot him seven times at the base of his stairs. Surveillance video near the scene and tips from Kruger’s friends and family led detectives to Davis, and a warrant was issued for his arrest a few days later. Police described the pair as acquaintances, and said Kruger “was trying to help [Davis] get through life.”

The family’s contentions come as detectives separately discovered and are investigating what multiple law enforcement sources have called explicit photos and messages in Kruger’s phone. The sources, who requested anonymity to discuss an ongoing investigation, did not say whether the images or messages were connected to Davis, but said they were “disturbing” and have been turned over to the department’s Special Victims Unit for further analysis.

Deputy Police Commissioner Frank Vanore said the contents of Kruger’s phone are part of the investigation as detectives seek to learn more about why he may have been killed. But critical details of what happened, he said, lie with Davis, who remains at-large.

“I think he could answer a lot of questions if he comes into custody and surrenders,” Vanore said. “It might help us put all this together.”

Damica Davis said her son called her on Friday, just hours after Philadelphia police burst into her South Philadelphia home looking for him. She urged him to turn himself in, she said, but before the call ended, he frantically tried to explain himself, though he stopped short of admitting to the crime.

“He was scared,” she said. “He said ‘... He wanted me to do some stuff I didn’t want to do and if I didn’t do it, he said he was going to blackmail me.’”

‘Put the pieces together’
Damica Davis and her older son Jaylin Reason said in an interview that Davis faced mental health issues from a young age. He struggled to control his anger in school, his mother said, partially because of the absence of his biological father in his life, and often got into fights. When he was about 15, she said, his troubles intensified after he started sneaking out in the middle of the night and coming home high on drugs.

They said Davis told them he was seeing an “older white woman” he met online who “worked for the government.”

They frequently saw the name “Josh” pop up in messages on his phone, they said, and when they asked who Josh was, Davis told them it was the woman’s brother, who was gay.

It was only later, in their call with him Friday, they said, that Davis told them he had been seeing Kruger all along.

Kruger worked for the city, including the Office of Homeless Services, from 2015 to 2020 — which lines up with when they said Davis initially told them he’d started seeing the woman who worked in government. And they’d followed Davis to Kruger’s block on Watkins Street before, they said, desperate to find out where he was going and getting drugs. They trailed behind and watched as he turned onto Watkins Street, but then couldn’t figure out which house he was going into, they said.

For years, Damica Davis said, “We’ve only had pieces of everything. We could never put the pieces together, and now everything is coming out and we see what’s going on.”

Davis sometimes returned home with expensive gifts, such as designer belts and Gucci pants, they said, and would tell his family the woman bought them for him. He’d sometimes stay out until early morning, they said, and return under the influence of drugs. They found needles, pills, and other drug paraphernalia in his pockets, and believe he became addicted to meth.

Damica Davis said that she tried to get help for her son but that resources were limited. He never stayed long at any rehabilitation facilities, she said, and other institutions “treated him like a prisoner.”

His drug use escalated. He struggled to hold a job and sometimes scrapped spare parts and metals. He was arrested in August and charged with trespassing after police said he broke into a building at the Navy Yard and was acting erratically. The charges were dropped after the security guard who witnessed the incident failed to appear in court.

Davis’ family said he was home the week Kruger was killed, and behaving like his normal self. On Friday morning, Reason said, he returned home from his girlfriend’s house about 3 a.m., and his brother came home about 4:45 a.m. with his cart of scrapping materials. They argued for a bit about why Davis was out so late, Reason said, then he Reason went to his room.

Then, at 6:01 a.m., Philadelphia Police and SWAT Officers burst through the door with a photo of Davis and a warrant for his arrest.

But Davis was gone. Reason and his mother said they don’t know where he’s hiding.

Damica Davis said that if her son did kill Kruger, there’s no excuse. But she, too, wants answers.

“It’s tragic what happened,” she said. “But I feel like my son is a victim in this, as well.”

A difficult past
Kruger, for his part, was transparent about the struggles in his own life. He has said he was homeless for years and was addicted to crystal meth and used intravenous drugs. While on the streets, he wrote in 2017, he relied on sex work, his religion, and the kindness of others to survive.

“I saw a lot of trauma and acted out of a lot of pain,” he said about that time of his life.

He said he started making changes in 2013. He said he got sober and wrote for blogs and alt-weekly publications about his experiences. Then, in 2015, he was hired by the city. Over five years, he oversaw the mayor’s social media platforms, and acted as spokesperson for the city’s Office of Homeless Services.

He returned to writing in 2021 and for various outlets including The Inquirer, he typically wrote about the issues that intersected with his life, including living as a gay man with HIV, addiction and harm reduction, and city and state politics. He became known for his strong positions and activity on social media, and grew a following.

Police sources say he was concealing parts of his life, and that meth was found in his bedroom. Still, news of his death left many shocked and devastated. City and state leaders shared statements celebrating his life and support for vulnerable communities.

Police, meanwhile, are working to figure out how it all fits together.

“We’re looking at everything as part of the case,” Vanore said.
 
Josh's statement about CEO's being there just to build reputation is semi correct. Ideally the CEO only really exists to represent the board of directors who are ostensibly the shareholders. They act essentially like the prime minister should in most European countries. However some companies have unique circumstances causing their company to be managed differently.

Disney is one of the best examples of this. Disney's board of directors is mostly staffed by people who Bob Iger hired at the company decades previously. So he had way more say over how the company is run primarily because everyone there only works there because of him. And he regularly muscles out anyone who doesn't play ball with his vision. Kathleen Kennedy only became president of Lucasfilm because Bob Iger convinced George Lucas to sign it over to Disney and named her as the successor.

The only reason Bob left and named Chapek his successor was there was growing discontent with the board of directors and shareholders at Disney at how Bob Iger was essentially becoming a dictator. As Josh has mentioned in the past you can sue the CEO of a company if they don't do what the shareholders want. So his plan was to essentially get someone else to take over as CEO but he would essentially convince them to do everything he wanted as the new chairman of the board of directors. This didn't work because Chapek immediately tried to become the new Disney CEO instead of just doing what Bob Iger wanted. So Bob Iger then using the rest of his board of directors manufactured a crisis at Disney with the Scarlet Johansson lawsuit and the drama with Ron Desantis in Florida. This allowed them to force Chapek out and put Bob back in as CEO. However this has easily been his worst decision in history as Chapek actually greenlit a lot of projects that did well at the box office. However everything Bob Iger has tried to do since returning has massively flopped. And now the company is spiraling so badly that there's now speculation that the shareholders are straight up going to revolt against him and the board of directors. A single shareholder named Nelson Peltz is trying to muscle his way onto Disney's board of directors by buying up as many Disney shares as possible because they're worth pennies right now. And he's amassed something like 30 million shares. And there's speculation if he gets on the board he's going to try and force Iger to resign from the company.
