It's disheartening to see how blase people are to this whole situation and being like "Okay, he responded. That means he's innocent! He's such a good guy! I hope the legal proceedings will be done soon so that will be the end of this."

When in reality, I think it made him look even more guilty.

he could have said, we want to maximize the impact on research for this charity and will donate in 100k chunks to meets the requirements.
when he talked to muta and karl on that discord call, he seemed totally lost as if he didn't know it was an option, after running a charity for 9 years and not donating shit.

Very strange. Basically, they held the money until they had enough of a big bag to donate. Yet they still never donated, were they expecting to pull a mil year one or something? Why wait? Why do you need a certain amount to give? Instead of just donating money to research or whatever, you sit on it for close to a decade as the value slowly rots away. How do you just sit on the cash man.

It's like he thought oh I'll rake in as much as AGDQ does and wave around this giant million dollar check to donate, but that's such a dumb mindset, cause they didn't even hit a million dollars until 2015's events. The very first AGDQ made at most 50k in donos for their charity. The point of doing a charity isn't to wave a check, it's to be altruistic, just as an FYI Jirard.
 
Honestly, given how long they were working on this response, it's very lackluster.
He totally handwaves the charity situation, holds on to the e-signature thing (which I'm fairly certain either Muta or Karl acknowledged in a subsequent video) and possible miscalculations on the golf event front, pretends his family is in danger and that people saying his shady actions were shady are malicious. Throws in a "just clerical errors" for good measure. OK, dude.

The frown and the beard shaking as he spoke won't work as well on people that weren't already on his side.

Our legal and financial teams have assured us we have done nothing criminally wrong or illegal. Any possible issues in our paperwork can only be described as clerical errors and are easily amendable.

You know what a clerical error is Jirard? When I would walk into a bank to make my monthly car payment; I'd fill out a slip with all the relevant info, hand it to the teller, and she confirms the transfer. I then get a call a week later saying my payment is late and they're gonna hit me with late charges, I say no, in fact I did it on x-date, and the bank pretty much calls me a liar. So I return to said bank, present my receipt, tell them about my phone call, and ask me where the fuck my money went if not to my car loan. Oh, turns out, the teller did mistype a number when inputting my car loan number, we're really sorry about that, no foul on your part, don't worry about the late charges.

You know what a clerical error isn't? Sitting on a decade of cash donations, where you spend time during every charity drive saying where the money is going; but for some reason, never donating said money, FOR AN ENTIRE FUCKING DECADE. Then when two autistic detectives get you on a call and you admit that you knew the money wasn't distributed, sit on it for another year, and continue to name drop where the money is going, only to not fucking donate it yet again.

You know where the difference is Jirard? I made an honest attempt to make good on my pledge to pay at least x-amount of dollars per month for my car loan. You just sat on the fucking money and didn't bother to do anything with it (that we know of); as evidenced in your own public fucking filings. Now I don't know how charities are ran, I don't know much about them at all, but what I do know is when someone says the money is going to X, Y, and Z, and for some reason it never makes it to X, Y, and Z; it looks bad on the organization and the faces the organization puts up front. Maybe there is no actual legal crime here, but you still look like a fucking greaseball used car salesman, and not just because you're fat, but because of your failure to distribute money to said organizations while bringing in even more dollars.

Content creators and influences should be held accountable when faced with serious allegations, however the narrative can get taken so far away from the truth that the court of public opinion supersedes fact.
Ten years of IRS filings showing a big fucking ZERO in the funds distributed/disbursed/whatever. I don't like the fucking IRS, but if you're gonna say the IRS lied, for an entire fucking decade, fucking prove it. I don't like them, but if there's one thing they're generally good at, it is recording numbers.

Taking accountability would be coming out and saying you fucked up or the IRS is lying, anything else is manipulation. Someone at the foundation, had to sign off on the papers before sending them to the IRS. Maybe you weren't the one to sign off on it, but you were the face of the org, and even admitted to knowing the funds weren't disbursed for a full year before this came about. You fucked up, you're not pristine, and don't take this as an attack as no one is; we all make fuck ups, some bigger than others, but unless I get a video of you beating your family members (the other organization members) with whip for failing to uphold the memory of your mother, I don't fucking believe you.

I own up to my part in this but I will not be painted at someone who is a con artist and embezzler.
Release the books, the entire decade of account transactions; complete with date/time stamps. Whether to the public or to the courts, someone's gonna have to see them eventually, and is the quickest and easiest way to prove no wrong doing... if there wasn't any wrong doing. Unreasonable, sure, but unreasonable accusations require unreasonable actions.

I won't be someone whose name gets tarnished without putting up a fight.
While I may be wrong; Karl and Muta seemed to do a pretty good job of laying a foundation and asking questions, not making accusations. I don't recall them saying anything about Jirard or your org and how you're all a bunch of crooks; what they did do though is ask where the money went. I'm not gonna say there's a simple way to make this all go away; but there's an easier path to clearing your name without this rhetoric.

I owe it to my friends, my family and myself to stand up to this situation right now.
If you truly are innocent, your family may be the biggest problem, as they also have hands in your organization. And if you're not responsible for the malfeasance, that means one of them are. You owe it to your mother to honor her memory, not make yourself look good.

It seems like a good response, nice and emotional, and gives some information that could make him not guilty.
However the questions I still have:

- Is it not a problem to advertise your charity by showing the charities you wanted to donate to/ saying you will donate to them? Technically waiting years to donate the money would still suffice if you didn't give a time frame, but with the logos it still seems sus. Though maybe a charity can change it's mind and donate to another organization.

- Why didn't the documents include expenses?

- If they really just wanted to wait for a restricted donation, how come they donated right after the drama started? If they already had the money they could have donated sooner, quite the coincidence that wanted to donate right now.

But let's not forget: the funniest outcome would be that he is right, because Karl and Mutahar would never admit fault after spending this much effort investigating and milking the situation. This could become and impressive autism explosion.
 
Watching this again only raises more questions. As much as his faggot fans claim he was “bringing receipts” he literally did not bring a single receipt. He talked about expenses, listed off all the different ways it costs money to run an event, but literally did not provide any receipts.

Secondly, if he changed the foundation from a private foundation to a public charity, and the 60 month period of continuing to file as a 990-PF ended in 2020, why was OHF still filing as a 990-PF?

His proof of a “audit” is not a financial audit. It’s an audit of the Foundations standing of being a Private Foundation. He is still misleading people.

I like how he tries to sweep the hard questions under the rug as “clerical errors” that can “easily be amended.” Ok, so what exactly are these errors and how will they be amended?

Once again, he has made a deceptive video that preys on people’s ignorance. He does not want a audit, he’s totally fucked and he knows it.

I want to touch on the last two. So I have a couple of family members that are chairmen at a golf course. They told me that registration is full. Very full. As in two to three year wait list full. Why? Because golf was one of the few things that people could do during the pandemic. This is in a very leftist area, with many of them still masked up and still fearing Covid. So saying there was less people participating? I'm not too sure about that one.

As for the incoming lawsuit, Jirard you contacted both parties before they posted their videos. If you want to blame anyone, blame yourself for giving shitty answers. If this really was a misunderstanding, you had a chance to correct it before any of this happened and you blew it. Good luck fighting a literal recording of yourself in court.

They haven't actually sued yet. Despite all the grandstanding and ire, Jirard never once says that they're suing. But that's the whole point of the end of the video to try and threaten Karl and Mutahar with just the threat of litigation.

one problem could be jursidiction, suing a canadian and a brit at the same time. that wont stop a suit but it could delay things.

Watched his video again and the question I have is why don't they rate a penalty for the years 2013 to 2016, when they were a private foundation that required a 5% payout. You say that a private foundation is different from a public charity, and I have no reason to disbelieve that, I don't know shit about charities. But at the same time, that's 3 years you operated as a private foundation and for 3 years failed to make your minimum 5% pay out. Was the IRS kind enough to waive the penalty as well as the requirement to payout? Was the penalty not something to be recorded? I'm not a lawyer and I'm not a CPA so I feel this is a relevant question.

This is probably one of the most important parts of this whole ordeal. So a year ago, he gets on a call with Karl and Muta and he fumbles his way through things. I'm no CEO, but when there are questions I don't know the answer to, I just say "I don't know." And if/when pressed on I should know, okay, but I don't, at least not right now, but I know where to get said info. While it no doubt would've taken time away from his bing bing wahoo, if there is no foul play, he should've wrote down what they wanted and reconveined a week or so later for things. I mean, sure he's in the foundation, but he also admits no one takes a paycheck from it, meaning they're probably pretty hands off with it; so yeah, he's probably not up to date with everything, because he and everyone else in it have full times jobs and stuff. But tell you what guys, give me a list of your questions, I'll call up my lawyer and accountant and see what I can do to appease your concerns.

As an aside, I tried googling something akin to "minimum requirement for restricted donation" and can't get anything about an amount. Lots of stuff from the IRS, Bloomberg, and other related websites about the differences and why you'd want restricted over non-restricted; but nothing about a required amount to make a restricted donation, which Jirard claims. Anyone else know anything about that?
 
If I have to make a guess I think his family is pulling the strings in the background. They are probably afraid that the gaming shit they dont get from the black sheep of the family is uncovering the shady shit they have been doing with the charity for all those years.
