The mother of the hulking Florida teen who beat his female teacher unconscious over a Nintendo Switch video game claimed prison time would be a “death sentence” for her convicted son.

Leanne Depa pleaded for leniency for the now-18-year-old Brendan Depa, who faces up to 30 years behind bars for slamming Matanzas High School paraprofessional Joan Naydich to the floor before kicking and punching her in the back and head more than a dozen times.

In her first public appearance since the February beatdown, the grieving mother Wednesday begged Naydich to request that the 6-foot-6 teenager be handed a lighter punishment.

“I am so sorry for what my son did and nobody should ever have to go through that,” Leanna Depa said on an appearance on NewsNation’s “Banfield” through tears.

“But at the same time, please consider that my son has had a hard life and he’s gone through so much trauma in his life. He has autism. Please show mercy to him.”

Brendan Depa pleaded guilty last month to beating Naydich over the video game when he was just 17, leaving her with five broken ribs, hearing loss and what she claims are ongoing cognitive problems.

The disturbing incident — and teachers’ futile attempts to stop the attack — was captured on the school’s surveillance footage.

Naydich has previously told NewsNation that she wants her attacker sentenced to the maximum of 30 years behind bars.

“I feel like if he gets sentenced to prison, it’s a death sentence for him. He’s scared. And to have your child call and cry and say, ‘I don’t want to die’ — it’s awful,” Leanne Depa said.

The mourning mom blamed a laundry list of mental disabilities and a history of childhood trauma for her son’s behavior — and questioned why he was even permitted inside the Florida public school.

Brendan Depa — who grapples with severe autism, ADHD, oppositional defiance disorder and reactive explosive disorder — was placed in the school by his intensive behavioral group home despite his time at an autism behavioral hospital just two years earlier, she said.

“I had always homeschooled him because he didn’t handle the school environment. I asked the group home, ‘Did he have to go to public school? Could he not do school online?’ And I was assured by them that all of their clients went to public school,” Leanne Depa said.

“I never thought he belonged in public school. I didn’t have a choice.”

Leanne Depa added that he should have never been near the Nintendo Switch during school hours and that a crisis team is typically called before professionals take the game away.

Naydich said she had never taken the game away from the teenager, but that he lashed out after another faculty member prohibited him from playing with it.

Brendan Depa’s behavioral issues, particularly his autism, do not constitute a defense in Florida, according to the mother.

The teenager was initially charged as a juvenile before the federal raps were upgraded.

The troubled teen had three prior battery arrests before the assault on Naydich and was reportedly involved in a jail fight in September.

Brendan Depa is being held on a $1 million bond. His sentencing hearing will begin in January.

I feel for the mother, I really do, she tried very hard to do the right thing but with individuals impaired to this degree, there is no "right" only harm reduction. Even if the plan had been followed perfectly, at some point this still would have happened because in the real world, shit happens. At some point a minder would have got stuck in traffic on their way to school, or a classmate's meltdown would have triggered one of his own, or a mainstream student would have been a shithead and set him off deliberately... Even if his medication had been reviewed like his mum wanted, it takes months, if not years to get the best combination and quantity worked out. And when you do, it's certainly not unknown for these medications to randomly stop working for no fucking reason, or the manufacturer reformulates or even stops making the permanently because they're 'old fashioned', and suddenly you're right back to exactly where you started.

No loving parent wants to just write off their kid. And that's the way it should be. But this kid needs to be somewhere where the environment is 100% controlled and there are strong, experienced wranglers within arm's length if he throws a hissy fit. If that can't be arranged, then prison is the only option. No one's freedom should be at the expense of innocent lives.

It also seems that any attempts to fix it, even with a bandaid fix, are met with heavy resistance by both the people who never experienced dealing with a Brendan Depa as well as certain sections of employees who utilize the job as easy money. It also doesn't help that the employees that do give a shit are beyond burnt out and on occasions heavily battered.

He doesn't seem to be the "retard does not know his strength", all his "conditions" are covering for being a shitty person. I'm sure he knows the difference between right and wrong...if he does, prison time, if not, sit him down and tell him about the rabbits, if you get what I'm saying.

He's been arrested three other times for battery. At some point enough has to be enough.
 
I spotted that article who mention the case of Brandon Depa in the aftermath of that case along with lots of similar events and it's a warning tale then we should keep an eye on this.

Former public school history teacher sounds the alarm on the next ‘powder keg’​

Frank McCormick describes himself as a “conservative history teacher in exile” and a “public school whistleblower,” and he runs a blog and hosts a podcast, both under the name Chalkboard Heresy. This morning, I came across this post, which has since been viewed more than 2.2 million times in less than 24 hours:

A number of recent stories came rushing to mind:

  • Brendan Depa, a 6-foot-6 and 270 pounds 17-year-old student who had three “battery arrests” before he pummeled and stomped a school employee (into unconsciousness) after she instructed him to put down the Nintendo Switch while he was in school.
  • The “caught-on-camera” mass brawl in a North Carolina high school, which left a 15-year-old student knifed and bleeding out on the gymnasium floor—the unidentified victim quickly succumbed to his/her injuries.
  • National Review’s investigative series into Ontario’s public school system—the first installment covered “progressive discipline” while the fourth installment covered the teachers’ cries for help “as schools descend into violent mayhem.”

Apologies for the bump, but the tard in question has recently filed suit against the school district, and it's glorious. it's essentially just an endless list of all the shit he pulled, and then blaming the district for not magically fixing it. The cherry on top though is:

He was punished by being denied his electronic device, even though other students were allowed theirs. The paraprofessional and the teacher began discussing his ability to bring electronics to school, in front of him and in front of his classmates. Brendan attempted to defend himself. The teacher and the paraprofessional ignored him and continued to talk about him in front of him and his classmates. The paraprofessional threatened to take his electronic device and Brendan got even more upset. The matter continued to escalate. Brendan eventually spit on the paraprofessional. The paraprofessional got mad and accused him of assaulting her and stormed out of the classroom presumably to report him for assault. The video shows the paraprofessional leaving the classroom and this student following her out.

49. The paraprofessional should not have interacted with the student in this manner. Her and the teachers actions caused a predictable outcome. While her anger at B.D. for being spit on is understandable, her response is not an evidence based intervention to address the spitting or defiance by B.D. The IEP and behavior set out the evidence interventions that should be utilized when a student misbehaves. The paraprofessional did not follow the plans and did not utilize an evidence based strategy putting herself in a dangerous situation. An avoidable situation.
