I think it's not so much the condition of the hair itself as the incongruence. AGPs pick "femininity" markers and mix and match them like an alien trying to skinwalk a human.

Plenty of women let their dye jobs fade or don't bother (or don't have time) to blow dry or style their hair, but their general appearance tends to match that. It is a good question on what is required of a culture that men and women have to have to express themselves. Orange Skirts and dresses as opposed to regular prison jumpsuit pants would be stupid, but a hardcore trad christian/muslim/jew woman might say they need it. What qualifies as cultural care? Is the guy wearing a traditional tunic with leggins or just underwear still a man if he wears it? What qualifies it as a skirt verses a tunic, and why would he not be allowed to wear it in prison verses a trans woman or regular woman wearing a similar outfit, but labeled "skirt"?

I'm being extra picky but laws and rules are like that. It's one thing for a Jewish prisoner to wear a Kippah, it's another to define fashion terms.
