Quite. If the email is real, it smells more like a Reddit user than a Farmer.

Reddit is where I first discovered Russ, either in r/niceguys or r/cringeanarchy. He's well-known enough on reddit that his name doesn't need to be censored. Plus he's posted his songs and such on there under his own name multiple times, ordering redditors to "make it go viral."

I can't wait for his inevitable victory lap if/when SCOTUS refuses to hear the case.

He's already made big posts declaring total victory over KF at least twice and offering himself up for interviews and TV appearances, then quickly deleting them. I'm sure he'll do it again.

Are there diminishing returns for lawyers?

Yes. The advantage of a more expensive lawyer is that he is likely to be more knowledgeable, meaning he might bill you less for research and mount a better defense. In a long case the pricy lawyer might end up cheaper. But there’s lawyers like Randazza and Giulianni, who are not only very expensive, but their price does not reflect their competence. They are the sort of lawyers who focus on bleeding you dry before maybe winning your case. Randazza, for example, is currently deliberately sabotaging Nick Rekieta’s defamation case just so he (the laywer) is paid more.

Is 400/hr not more than usual?

In New York where his lawyers are situated it is (by averages) more or less usual. More than usual if we count only low-experience lawyers (technically the second link is for criminal lawyers, but you get the gist). In Utah, where this case is taking place, that’d be above average

If they do hear the case can he proceed pro se?

Yes, but it is my understanding that he can’t appear in an oral argument (which is good, because they wouldn’t understand him anyway)

It depends on the practice and the location. My attorney costs more than $400/hr but he's the owner of the practice and it's in a very wealthy area. It's a very broad range. I'd question hiring someone at $200/hr but that's just me.

At least some state bar associations periodically publish economic survey data on hourly rates. I base mine off the median for my geographic area/years of practice.

Regardless if the email is real or not, there is ZERO evidence that this person is a "Kiwi Farms user" as Russell states in his filing. I'd imagine there are hundreds of lurkers in this thread, not to mention people simply following the case after the media attention it garnered on appeal.

Given this mystery troll felt emboldened enough to specifically taunt Russell about the fund with an insult specific to his thread history, Russell assuming he's at least a long time lurker here is completely reasonable, if not legally relevant. It's probably the most logical assumption he's made in the last 5 years, since among them we must now include 'not expecting the people you're suing to have money and/or hire a lawyer'.
