18 U.S. Code § 2252 - under federal law child pornography is defined as verbatim "Any DEPICTION of a child engaged in a sexually explicit conduct". Any depiction. I does not have to be a video or a photograph. It can be AI-generated imagery, a pasta collage, a crayon drawing, a fucking statue if you will. Loli falls squarely under this statute. Now there's two tests to this: 1. the image has to be indistinguishable from an actual child (real or fictional) - loli is meant to portray children so it's not an issue. The image also has to have a artistic or scientific value to be protected under first ammendment- images of children getting fucked by horses are neither a work of art nor an image from a physiology textbook.
What's even funnier: people have been prosecuted and sentenced for mere posession of lolicon under US federal law. The feds usually don't go after loli itself but if Vaush is ever a subject of a federal investigation and the feds get in possession of his hard drives... yeah.

It is CP. According to the PROTECT Act of 2003, lolicon meets the federal criteria for child pornography. If you are caught in possession of lolicon or shotacon, you could face federal criminal charges and significant prison time if convicted.

There are two "possession" charges: simple possession and possession (think drugs). Simple possession is when you have small quantities of it with no intention to sell it. Possession is if you have a lot of it with the intention to sell or distribute it. Merely having some pictures of lolicon pornography on your computer is creepy, but will probably not land you in jail. That's probably why anime image hosting websites that contain fringe content like this haven't been taken down from Western servers. They're merely displaying it with no "intention" on distributing it.

There's also the notion of what "obscene" means in a legal standing in the United States, which is another can of worms that I can't wrap my head around.

This is all just speculation of course, but I would not be surprised if Vaush had no prison time for this.
