FYI all, Sean aka Potentially Criminal is doing a mystery stream tomorrow at 11am EST ... Which is 10am CST. Only posting this here in case he got permission to stream the court for the balldo appeal, which is coincidentally at that time.

Not liking the forum shopping argument. I'm not sure how it's forum shopping to come to where the defendant lives and sue them there.

Judge asks a really good question. Many courts consider anti-SLAPP procedural. Randazza conceded Minnesota procedural rules would apply. Judge's point is wouldn't Monty then be entitled to discovery before a dismissal, i.e. anti-SLAPP would simply not apply as normal, considering a stay of discovery is one of the fundamental parts of it.

So even if Randazza wins this, the case would seem to have to go back to find out whether or not discovery is justified.

Incidentally I myself mentioned the particular test Monty's lawyer cited. One of the judges seems skeptical of that.

This guy is not as smooth as Randazza.

The plaintiff shouldn't file in their own backyard when there probably wouldn't even have been personal jurisdiction in Colorado.

Just because someone posts something on the Internet doesn't subject them to jurisdiction in every possible state. I'd like to know how Colorado would even have personal jurisdiction just because Monty lives there. Cases are routinely dismissed for lack of personal jurisdiction over Internet defamation cases.
 
Back of the envelope math on how much this hour and half will cost Rackets.

Assuming $1,000 an hour for Randazza. That 1.5 hours is $1,500. But that is just the START.

We also got to figure the Paralegal(s) time. Assuming Randazza just brings one paralegal at $450 per hour

Air Fare (round trip) from Las Vegas to Minneapolis. And our boy Randazza is not going coach. He's also not gonna force his paralegal to ride coach either!

I'll note that they're being really generous in throwing extra questions at Monty's counsel, effectively giving him extra time.

Nice, Calder v. Jones, one of those 1L cases.
