This was probably the worst legal take I've ever seen from him.

It's worth noting out that Monty may have been listening to actual real lawyer Nicholas R. Rekieta who made the same mistake last month when he implied that one of Null's attorneys made "a false statement under oath in [their] filing" by pointing out that trying to sue a website is a nonsense and Russ was looking for Lolcow LLC.

Filings are not under oath unless it's something like a "verified complaint" that requires an affidavit with the facts alleged in the complaint, and then it is only the affidavit which is under oath. Knowingly making false statements in a filing isn't legal, but it isn't perjury. It can constitute a fraud on the court or some other offense, though.

Randazza couldn't have committed perjury in oral arguments, not only because it wasn't under oath, but because facts weren't even being argued, just law. Legal arguments could be frivolous, or wrong, or outright dishonest, such as lying about case law or deliberately hiding contrary case law. Randazza didn't do any of these except possibly be wrong, and that's up to this appellate panel since it appears to be an issue of first impression, that is, there is no directly on point case law.

I personally think it's a stretch, but he did a better job both briefing and arguing his claim than the adversary. This isn't to dis Monty's lawyer too much. He did an adequate job and isn't one of those big bucks lawyers. My only real gripe about him is the panel and Randazza were throwing around the term "forum shopping" as part of the reason for applying Colorado law (to discourage this practice). I'm entirely unconvinced Colorado would have even had personal jurisdiction over Nick just because he talked shit on the Internet. Cases are routinely thrown out for lack of personal jurisdiction for that reason. It may have been an act of futility even to attempt to file in Colorado, just to have it thrown out for lack of personal jurisdiction, and then go sue in Minnesota.

It isn't forum shopping if you only have one forum to sue in (other than presumably federal court under diversity which might have changed the choice of law issue).
