Litigation Fund

I didn't have to sign an NDA but the outstanding issue is resolved.

- They retract.
- They issue a business certified copy of the retraction.
- They help me reclaim a domain that would otherwise be lost for good.

Someone else hasn't been returning our certified mail and now with this retraction there is zero basis to their claims. Not retracting now is proof of actual malice. I'm not asking for much here.

At first I thought, why not take their money!? Then I remembered Epik doesn't actually have money and you would have to fight a long, long list of creditors to see a shred of a cent from them. This actually makes sense. Knock Epik down a peg and force them to shore you up on the LFG tortious interference front. It's actually kinda brilliant.

Oorah!

But for real, how is it that these people have enough skill to do ddos shit and the like, but don't have the ability to hold a job very long? It's like they're built wrong as a joke.
They don’t. They just pay people on Telegram and other shady avenues to perform DDOS attacks for them, like how people would pay Torswats to swat their online enemies instead of doing it themselves. It’s an even gayer form of illegal aloggery than regular DDOSing/swatting. Didn’t Null write an article about how cheap and easy it is to buy DDOS attacks powerful enough to cripple most independent websites? I think it was on his Substack, but I haven’t read it in a while. I could be thinking of a post on the Farms.

Anyways, congratulations everyone, especially Null and Hardin. I’m trying to avoid hubris, but when a DDOS attack starts almost immediately after the announcement you just know we must be winning hard enough to piss some worthless faggots off. I expected one eventually, but not literally instantly. That warms my cold, fuzzy Kiwi heart greatly.

what about the damage that has been done in the meantime?
From what I've read it's almost impossible to claw back money lost due to false DMCA claims. I know that's a separate form of lawfare, but Null chose to take what he could get. It's the prudent adult decision, even if it would be great if Null could punch coins out of them like Mario hitting a question block.
We still get a "ha-ha, whoopee".

Apparently the company that bought them is indeed huge and does have money. However, the point I made earlier remains the same. When Registered Agents, Inc. bought them, they bought their liabilities as well, and this is just one resulting from a slapfight the previous owners started that they have absolutely no reason not to resolve immediately and as amicably as can be done.

But but I thought this wasn’t defamation. I thought you couldn’t defame a website. I thought there was no defendant.
Not like this Rekieta sisters…

Alright then, but what about the damage that has been done in the meantime? A retraction isn't the slam dunk that many seem to think it is, for several reasons.

This public retraction is a major victory. Companies and activists were using the existence of the original statement as justification for dropping the site. “Kiwifarms has CSAM, Epik LLC says so and they’re a reputable business.

The claim itself is what caused issues. Now nobody can use Epik as justification since they openly admitted to lying and issued an apology, true the site isn’t out of the woods, but we were given a chainsaw and enough gasoline to start removing trees one by one

This is a shit argument. Its illegal to be a tranny in many countries, how about that? If the Internet abided by the laws of every country on Earth, it would be impossible for its existence to continue.
He's such a nobody, but I hope he gets a nice certified letter too.
