Insanity isn't a defense in a civil case. I suppose it could negate capacity to have a specific intent in a specific intent tort, or relate to damages (if someone is a known nutcase people might not take their ravings seriously) but it would have to be at the time of the defamation, not months later.

If it even exists, it would be an affirmative defense, though, up to Nickhole to prove at trial.

Monty seems pretty harmless to me, to the point he's barely even a lolcow, which his nearly dead thread seems to confirm. He doesn't deserve to be called a child molester by some spiteful asshole doing it just to milk it for money, and I'm glad Nick utterly failed at such a transparently craven and despicable grift.

Oddly, that may be a reason it would be hard for him to establish damages. That is, I think his reputation is actually better after being viciously attacked by Nick than it was before. That's not really a defense in the defamation context, though, because one of the main reasons his reputation has actually improved is for suing this fucker. Nick more or less forced him to do this, and is acting like it's Monty's fault somehow, and if not Monty's fault, then Metokur's.

still way behind on the nick stuff but i just want to say he's a fucking idiot. Nick befriended a dude looking for a maddox and nick gladly gave him one. Dick would barely be a notable podcast without his villian, same with redbar. Aaron was looking for an opponent to "take down" and get obsessed with so people will watch his show and Nick is gladly being that villian.

I personally would have not gone the immunity route, but rather the damage limiting route. Randazza sorta sprinkled in those arguments, but seemed to abandon them in favor of the immunity ones. I suppose if he goes back to them on trial, he could still win. He'd have to fire Randazza because he is literally sabotaging his case for more money (though the appeals were pretty decent even though he lost)

I've said it before, but it bears reiterating: Nick was barely smart enough to perform werks like this before, and now that he's completely retarded there's no way he can execute a conscious strategy like this. I've seen Null and others try to ascribe some motivation to his actions, but it really is as simple as Nick having genuine brain damage. He's fucked.
