Nick told the cops she is visiting them during the arrest. She probably told cops the half truth, that she is getting divorced and was staying there through difficult time, sob story partially correct. If they thought they could pin possession on her they asked prosecutor and he refused to charge her on paper thin circumstantial evidence alone. But I think they never even approached prosecution with April. The charges are for possessing - not consuming drugs somebody just throws at you. I don't think they have anything on her, unless Rekieta starts throwing her under the bus and lying that April was the one who supplied the drugs in part or in whole.

They'll both get in lieu of conviction deals which assuming they can survive a year (possibly two) of felony probation they won't spend a day in prison. They'll both have to also attend counseling/IOP/AA.

Not a Saul but I was in a similar situation with LSD and firearms. Nothing stuck, never been a felon only charged. If Rackets can realize what he's throwing away like I did with my wakeup call he'll be fine.

I'm guessing she can't say anything too direct or specific so as to avoid direct evidence of bias, but if she inserts some vague reference ("Bailif, before the defendant takes his seat, please put a towel down on his chair").... :story:

Nick waived his right to remain silent and said he slept in the master bedroom with his wife to the police. Drugs and a gun/ammo were found openly in that bedroom around and under the bed. I am not a lawfag, but one of them was explaining constructive possession and here is the definition I pulled off a website.:
  • The person must have knowledge of the controlled substance’s whereabouts (e.g., on or near their property); and
  • That person must have the ability to maintain dominion and control over them or the area in which they are found.
The prosecutor has them both on the drugs and a gun/ammo by Nick's own words.

Big thing from this. Potentially Criminal says Rekieta's kids are almost certainly subject to a sealed dependency action. They are formal wards of the State and only passed off to the Grand Parents as temporary custody following resolution of the action. These sorts of charges do not come absent a similar action by CPS when minor children are found at the crime scene. I agree with this interpretation as well. Juvenile actions are NOT public record, but CPS was the originating cause of action in the warrant and the result of a literal battering ram through the door is Major Felony charges on BOTH parents.

This is real shit. The Grand Parents must now step up and file for full custody, and I expect they are being told this by a case worker as we speak. The question now is which grand parents. Kayla's or Nicks. Kayla's will get preference because they live in Minnesota. Rackets parents I think still live in Texas, but I may be wrong. All the kids should be grateful they have extended family. if they didn't they would be in CPS Custody right now pending placement in foster home. Which is the next best thing to hell on earth after men with guns rip your parents from you.

You have to consider he is also being charged with Child neglect and large possession of prohibited substances
