In theory, they could. In reality, they're not obligated to do that. You don't get to disqualify every judge in your vicinity by just being such an utter dick that nobody likes you.

Not true. However, they can't necessarily force them to testify against each other. Spousal privilege (which takes many forms and I am not even going to look at Minnesota specifically) generally prohibits spouses, who were married at the time of the events in question, from testifying against each other, with a ridiculous number of exceptions I am not remotely interested in going into now.

I would assume that since alcohol isn't a controlled substance, it wasn't used in the committal of a crime, that Nick is above the legal age to own alcoholic products, and is only barred from the consumption/intoxication of alcohol they probably didn't take it.

a lot depends on how often you drink. it's much easier for a sober, healthy person to flush their system than for a chronic alcoholic.

what really matters is the test they use. there are tests that can check for signatures (in your red blood cells) and can determine if you drank months ago. your everyday piss test though is definitely foolable, and he's definitely foolish enough to attempt to fool it (being chief of tomfoolery, after all)

Apparently, you can fool Alcohol piss tests by sweating and drinking a lot of water. I wouldn't be shocked if Rekieta drinks heavily at night and assumes he can piss/sweat it away by daytime.

I do not believe he has been released under some kind of ridiculous conditions like "you can do all the drugs and commit all the crimes you like, utterly publicly, and we can't do anything if you do."

They did say it verbally in court. I listened live on MATI when it happened. Randomized testing was definitely in there. It sounded pretty simple to me man. No drinking, no drugs, no guns, piss in the cup when we want, and you don't pay 50k, or we fuck you over. That's how I interpreted the hearing from listening to it.

So what happens to that 48 month stayed sentence when he fails a drug test? If he gets a stayed sentence, he'll absolutely keep using.

Courts can be excessively forgiving for white people who can fake a respectable history/story. And to be fair, Nick does not have a record of criminal conviction in Minnesota, and just a couple of traffic/speeding tickets. He's an ostentatious ostensible Christian with five children who comes from a good home and had a "promising future."

As far as I see it he has two strategies available to him. I'm operating under the assumption that he has no remorse for any of this whatsoever.

He can be publicly unremorseful and say this was absolutely nothing and the police were being completely unfair.

He can also pretend that he knows that he messed up and pretend to fix himself and act remorseful while not being so.

The third extremely unlikely option is for Nick to actually be remorseful again.
