And that is exactly why Kayla should have her own attorney. There may be reasons, real or perceived, for Nick to not want Fischer, but Kayla has had no interaction with Fischer so much less clear a reason to remove her, and if this judge is a hang-‘em-high type of judge compared to Fischer, a real attorney may have advised Kayla to stick with her.

I completely agree. Nick effectively representing Kayla right now and making these decisions for her is both dangerous for her and a massive conflict of interest for him. Her interests in this situation are not necessarily the same as Nick's. She should have independent legal advice.

I think the judge will give them a path out if they are willing to take it. But they have to be willing to take it. The more they fight the process, the higher the risks they run of being made an example.

Average strung out or criminal defendant isn’t googling up their public defender in the same way a professional or business would.

Though the drama might be so much that even words gets around inside the county jail.

No chance Nick ever practices law again in any real way. First off he clearly didn't want to do it that much in the first place. Second, how often do people that achieve Internet fame ever actually just log off and go back to normie lives? Basically never. The only example I can think of, and I'm not entirely sure if this counts, is MundaneMatt. But I'm pretty sure ol' Jarbo never got to the epic heights of lolcowdom that Nick has. He is going to have Internet retards harassing him for the rest of his life no matter what he does.

He'll just go down the WingsOfRedemption path and limp along with whatever shadow of an e-daddy "career" he is able to cobble together. While he's never going to get rich off of e-fame like before, the fact that he still has so many Balldo washers after everything that has happened suggests he'll still have some kind of income from it.

There are some judges that will talk about closed/completed cases, but they certainly won't talk about a live one "out of order/off the record" because it's one of the few things left that can get your ass strung up.
Preparing filings for Kayla needing only her signature as "she" conducts "her" "pro se" defense would appear to go beyond the point of "informal advice".
Isn't there a bit no-no to have a lawyer create documents for a pro se defendant to sign? It's like ... some form of malpractice, I thought. Maybe it was in the UK or something.

It was granted.

There's a Minnesota Supreme Court case involving this very guy, Robert Brady Malone, with a dissent, from 2021, going into extensive detail on the standards for such recusals (when they are not your first freebie).
The error appears on both Nick and Kayla's filing.
He pasted it from someone else's. The one I found is better imo and explicitly states the elements necessary to comply with the local rule.
He really is doing the Beard strategy, let's see how it plays out!

I think he's patting himself on the back, but I also think he just majorly fucked up.

I doubt another judge will rule materially differently in this case, and a judge who doesn't like you can be better than one that doesn't care about you - if they're a good judge overall.
I don't. I'm pretty sure Fischer actively hates his guts at this point. The others probably merely dislike him.

Also my first impression of Fischer is I am unimpressed.
However, he just removed a powerful appeals line (even if bullshit).
Deliberately losing your case in the hopes of appealing it later is not exactly a great strategy.
Nick at least claimed to do a sober January.
No, he claimed he was GOING to do it, but called it off before January started, so his sober period was basically -1 days.

That request was under 26.03 Subd. 14(3), which is a request to disqualify a judge for cause.

You essentially get one "freebie" under Subd. 14(4), which is what Nick requested. The only requirement is that it's timely filed.

He also waited until he was alone with her in an elevator to talk shit to her, an intimidating male power move. She has not demonstrated anything that would let him prove bias, but there is no doubt in my mind that she hates his guts on a personal level, because who wouldn't?

If he's going to file this, now was the time.

Sucks for him that it might not help him but that's how the dice roll.

Part of the reason why I believe this is a no-brainer to use the freebie is that we don't know whether she already hated Nick and punished his client because of it. How much of it was the "privilege" of Nick's client, and how much of it was that she just couldn't stand Nick?

It's not worth taking the chance.

Nope, Kayla's was paid on the 28th. Nick was telling the truth about it being a paperwork error.

The request for [Judge Fischer's] removal was granted based on the timely filings from both Nick and Kayla from my understanding. (If there is an error in my post feel free to correct me).

Best timeline: Nick accidently ends up with a humorless "law and order" judge who gives him prison time, as Nick begs for his case to be re-RE-assigned back to Judge Fischer.

However, it's just as likely that this scum used his lanklet height to try to physically dominate her.

No, as noted earlier, they were in fact on the same day. It's possible he did it later on the same day after a change of course, but there's no evidence of that.

What I particularly disliked about that was he should have raised it in court, incompetently failed to do so, then tried some gotcha bullshit when he had her as a captive audience.

And, if he does acknowledge it, will he refrain to attack the judge this time?

I'm on the fence on the first matter, leaning towards the second option, and I think that even if he is somewhat self-aware he still will fuck up again. At this point, I don't believe he can help it.

My personal opinion is that people tend to have moments of stark clarity when the shit really hits the fan for them, but at the same time people who are coked up tend to be impulsive.

So two things may have happened here:

1: Nick saw the writing on the wall with Fischer as judge and decided to file a notice for removal.
2: He was too impulsive to properly think if this is a good decision to do for his wife as well, so he just ended up filing it as a knee-jerk reaction to the realization that Fischer is the presiding judge on his case.

But your guess is quite literally as good as mine. This is all speculation and we can't really step into whatever is left of his mind.

He also squanders second, third, and fourth chances, so I think the Rackets Empire is doomed no matter how mean the judge is.
 
This is exactly the kind of thing that they wouldn't do as professionals. They're above-board. In fact, the other judges probably did not look at ANYTHING simply because they know that cases can get handed around.

However, that doesn't prevent it from going around the town and becoming "accidentally known" to everyone. That's how small towns work.
Maybe the Pastor can screen Nick's YouTube during Sunday Service? The wrath of the Imaginary Sky Fairy shall fall upon them all. LOL
 
What would it cost to defend oneself in a case like Nick and Kayla?
If you mean be your own lawyer like Nick seems to be doing, it would cost up to twenty five years.

If you mean "hire an attorney to represent you" it could be free (if you use a public defender, which might not be that bad a deal if you reasonably plea out) to a couple thousand if you hire a local to do a basic plea, to infinity monies if you go full OJ.
