Hmm, I don't think I like that excuse. You're telling me you can sign an NDA, and then people can take illegal actions against you while you can't simply say "they're lying"? Seems like that's not true; it just wouldn't make sense. At any rate, say it is true: what happens if he breaks the NDA? I'm assuming its just a loss of money or something else material.

I have a difficult time seeing a guy said "Well, you see, I had to break the NDA to defend myself legally; people were commiting very real crimes against me" and a judge goes "The law is the law, you were prevented from using any avenues to protect yourself, so your options were 'be abused' or 'go to prison."

NDAs do not protect against illegal activity in the United States. Same with doctor-patient privilege or attorney-client. You cannot tell your doctor "I am going to commit a crime" and have them keep it a secret. They are obligated to tell authorities. Just like you cannot tell a lawyer "I am guilty" and then plead "not guilty" in court when they know that you are perjuring yourself and violating the court oath openly. They will get disbarred.

That's the problem, they can't. But they're both in deep shit if he did do it, because Twitch would be considered an accessory to the crime and he would be, well, fucked.
So their hypothetical "NDA" is just accepting that if either party would speak up that they're both legally in the wrong and that it's better neither speak about it.

If it's a third party, you're fucked. If it was someone at Twitch working in an official capacity making the accusations, then the NDA wouldn't apply, and it would be a free for all. Was Cody even working for Twitch when they settled the lawsuit?

And saying something isn't true could absolutely result in a breach of an NDA. If a confidential recipe could call for ingredient A, B or C, and someone who is in the know says it's not A or B, then it's clear what the secret ingredient is, even though they never said that it was C.

NDA is a civil contract, a breach just means that you pay money damages, not prison, so the limitations on your ability to defend yourself aren't that extreme. Although granted, I would think that the money damages would be worth denying that you're a pedophile.

Like any good internet drama, a lot of people are claiming they know something and staying quiet or getting really smug about concrete evidence not getting out. Even if the allegations end up being true, I hate how easy it is to destroy someone's reputation over information no one can verify.

It's not hard but people keep fucking up, which is why this is halfway believable.

Maybe the pajeet is right on this one. Maybe it was this: Twitch banned him because he was talking to a minor. He sued them because they banned him without giving an explanation. They revealed the reason, and his lawyers pulled out their trap card. Basically, Twitch is technically at fault for allowing a minor to use the whisper messaging, and Doc can claim, "I didn't know she was a minor," and they settled things. His language in all the Twitter messages is kinda Sus.



My main doubt in this situation is how Twitch knew she was a minor and Doc did not. (They wanted to meet at TwitchCon at some point, allegedly.) Did he go for the technicality even knowing he was sexting a minor? I don't understand people who think stealth tech exists; everything is being logged somewhere.

If that cody guy is to be believed it seems anyone at twitch can get access to the reason he was banned, meaning many other people not under an NDA would also be concealing it. What was this guys position at twitch? And IF this guy knows doc was sexting a minor and has known for years and didn't say a peep, why would you believe him?

In this day and age it doesn't matter - hes already been found guilty in the court of public opinion. If i were him i'd say fuck it and fade away with my money.

That's another problem, dozens of internet people that did not ever work at Twitch allegedly knew and didn't say anything. Nobody said a thing but hinted at it being seriously bad.
But again, you would have to believe them who believe weirdos now formerly employed by Twitch, which is a hard sell.

My biggest qualm about accepting this is I'm pretty sure there woulda been a clause in his contract saying that violation of twitch TOS = termination. I am also fairly certain the accusation would constitute a TOS violation and subsequent termination. So why did Twitch settle the contract? You can't tell me it woulda been cheaper to pay that settlement rather than the lawyers that are already being paid.

I put Doc on in the background while I work sometimes. He's been hinting for a while that he's getting sick of the streaming thing. I think his enthusiasm has been eroding since the Twitch ban and he's been sucking it up so he can keep the gravy train going. He doesn't like where the big streaming games are at now (Fortnite, COD, Escape from Tarkov, etc.), and he doesn't like the more experimental indie stuff either. I think he really likes the character and the bit and the vibe, but has been losing his passion for the actual streaming/vidya part of it and Midnight Society dropping him over these allegations (for at the moment that is all they are), was the final straw and he's just over it.

This all can be true whether he is guilty of grooming a ten year old or not.
