BONO, Ark. – Two people face charges of incest, a Class C felony, after their arrest this week in Craighead County.

At about 3:50 PM on July 4 at the 200-block of E. College Street in Bono, a man ran to a neighbors house to call 911. The complainant told authorities he, his brother, and his mother had been drinking at their residence. The complainant fell asleep. He then woke up to find his brother, Austin Casey, allegedly having sex with his mother, Crystal Fallis.
The PC affidavit for Casey says that the complainant initially thought his mother was the victim of a possible rape. However, authorities determined otherwise once they arrived on the scene.
Casey fled the scene a few minutes before police arrived, according to the witnesses.
The affidavit says that after an investigation and statements made to police, they determined no rape had occurred.
Crystal Fallis, 45, was arrested at the scene. A short time later, authorities located Austin Casey, 27, and he was arrested as well. Both are being held in Craighead County Detention Center on a cash/surety bond of $35,000, set by Judge Tommy Fowler. A no contact order is also in place.
Both are facing a charge of Incest – a rarely seen charge in Craighead County.

A Class C felony carries a minimum sentence of three to ten years and a fine of up to $10,000.(a) A person commits incest if the person, being sixteen (16) years of age or older, purports to marry, has sexual intercourse with, or engages in deviate sexual activity with another person sixteen (16) years of age or older whom the actor knows to be:
(1) An ancestor or a descendant;
(2) A stepchild or adopted child;
(3) A brother or sister of the whole or half blood;
(4) An uncle, aunt, nephew, or niece; or
(5) A stepgrandchild or adopted grandchild.
(b) A relationship referred to in this section includes a blood relationship without regard to legitimacy.
(c) Incest is a Class C felony.
