Clinton will not be prosecuted for most recent emails

FBI Director James Comey tells Congress that a review of new Hillary Clinton emails has “not changed our conclusions” from earlier this year that she should not face charges.

Comey sent the letter Sunday, just two days before Election Day.

In July, he chastised Clinton’s use of the private mail server but said that the bureau would not be recommending criminal charges against the Democratic nominee.


The new letter follows one Comey sent late last month in which he said agents would be reviewing newly discovered emails that may be connected to Clinton. They were found on the computer of Anthony Weiner, the disgraced congressman and estranged husband of Clinton’s close aide Huma Abedin.

The thousands of new emails were mostly personal and duplicates of what had already been seen, law enforcement officials said in explaining how the conclusion was reached so quickly. The laptop which was found was about a decade old with lots of personal content on it not relevant to the investigation, according to one source.
The probe is considered over with regard to Clinton. Though with not all the deleted emails recovered and not all the devices in FBI's possession, it is always possible something else could turn up that would require more review.

If criminal investigation took off before Obama leaves office, it makes it more likely for him to pardon Clinton. Something else will come up in due course, whether more WikiLeaks or more emails on somebody's computer.
 
As I've stated before, the reason Clinton isn't being prosecuted has nothing to do with her network of spies and murderers and everything to do with the law. All of the people squawking that "everyone knows what she did was illegal:" cite chapter and verse. What law did she break?

The Espionage Age specifically requires malice, not negligence.. The statutes that deal with negligence require the actual removal of hard copy classified material from a secured location. They have never been used in the history of the United States to ever prosecute anyone for unsecured classified data.

There are two possible statutes they could theoretically attempt to prosecute on, but one doesn't apply to digital files and the other one requires intent to commit espionage. That's why they didn't indict.

What she did was careless and negligent and showed bad judgment. People who choose not to vote for her based on that are making a logical and fair decision. But wasn't illegal and it doesn't become illegal just because it "feels like" it should be illegal.

Comey can't even properly throw the FBI's reputation under a bus. Jesus Christ. He's going to be gone after this election most likely, because this shit is insane.
