Regarding the need to prove damages, DSP's statement arguably falls under the category of "harmful to one's trade or profession" of defamation per se, so Keem wouldn't have to prove actual damages to have a valid case. If Keem wants to burn money to make a point, he could win the case with even $1 of nominal damages. The onus would be on DSP to prove the truth of his claim.

If Keem did win, DSP might be in a rather tight spot, as he can't declare bankruptcy again for a good few years yet.

On the one hand, fake and gay. On the other hand I would love to see Phil actually attempt to defend himself pro se in a lawsuit since he's too broke to afford a lawyer. Keem has a hate boner for Phil so could definitely see him spending some Boogie money on filing a piece of shit lawsuit against Phil. I do wonder what size of check Jim is extorting the gnome for though. The boogie checklist was clearly not fun for Mr. Metokur, and he definitely got paid for that shit.

If the concept is that broad it doesn't mean a damn thing. Reality shows are fake and scripted. They always are. That's just a well known fact. I don't see how saying the obvious remotely harms Keem or anyone else. I don't even know that running a repulsive freakshow is even a "trade or profession." That's for things like saying a lawyer is incompetent, a doctor is a quack, even a leading man like Tom Cruise did not make this argument when someone called him gay.

It's like a carnival sideshow barker suing for defamation because someone said he ran a freakshow where he showed freaks to the public for money.

This is the very definition of per quod.

I don't think Jim would sell out for Keem.
I think he was just getting sick of it. I have some doubts Metokur would have even done a third stream if it wasn't Boogie's birthday. That was just too good of timing to pass up.
I do remember at one point during one of the streams Keem piped up when Metokur was making a point and Metokur basically told him to shut the fuck up and let him speak.
I thought for sure Keem would have sperged out from being told to shut up - on his own show no less, but Keem actually did, thank god.

Re: if Boogie used Empirical ink in his tattoo that shit is expensive (1ml=$85 USD) which is a lot for someone who doesn't have money. but honestly I don't think some backwater tattoo shop in Arkansas just has some on hand.

Re: Defamation case, don't they not only have to prove monetary damages, but also social damages? He's got to prove by DSP saying that he harmed his reputation, and Keem already did that himself.

He 100% inspected element and changed it to $1000 on the donation "reciept" he showed. Donations of 1K or over are shown as $1,000 not 1000. He added at least 1 and possible more zeros.
And he picked PayPal instead of just a Bank Transfer like Mutahar did for the simple reason it was after close of business, PayPal wouldn't have processed it till the next morning, leaving him plenty of time to cancel the payment, instead of a Bank Transfer that would have been instant.
I just don't believe him. He's given no reason to think he is truthful about a fucking thing.

There's a reason he's refusing to show both payments on his statement.
He's a fucking liar.
