CPS was notified of the search warrant execution (there were children in the home). Upon execution of the search warrant on May 23rd, drugs were found. All adults were arrested. This put the children on a law enforcement hold. Sweep showed up fairly late in the process.

At this point, the children enter "CPS custody", even though they are placed with family. CPS is obligated to get involved at this point. Drugs found in the home is prima facie evidence of child neglect at a misdemeanor level.

The primary details for this are in the CPS omnibus hearing findings of fact et. al. issued by the judge.

I assume the county would get the subpoena from Google before trial. As others have mentioned, PC is a lower standard than a trial standard. Consensus seems to be that what Pomplun had was enough to get a warrant, but it should be better organised for trial scrutiny.

It makes sense to me, they got a report for possible child neglect and drug use, asked CPS if there was an endangerment problem with the kids, CPS said no not legally, and therefore the cop very specifically asked to look for the drugs and only the drugs. The warrant application doesn't really go into the kids apart from mentioning that there was a report of them being smelly and possibly neglected, which is just a fact, and also a sign of druggie parents. He then lists all the other stuff that signifies druggie parents, or Nick in particular.

The cop only asks to look for drugs and doesn't talk about child neglect as the crime at all. That's just gravy because guess what, being white trash drug addled parents fucking other white trash fucks up your kids.

Could your legal representative make a personal appeal to Pomplun after the hearing? I imagine Pomplun is a busy man, but I would think that he likely cannot stomach allegations that he is corrupt? You have the clips of Rekieta and Rekieta’s close personal friend Robert Barnes implying and alleging that Detective Pomplun is a dirty cop.

If it’s not a hassle could you see if any of the lawyers think that might be possible avenue for the bodycam? I don’t want to piss off the cop, but if he’s gonna be there and you have a lawyer there, well, it might be worth a shot.

I was about to say the same thing, all this last minute stuff almost feels like a strategy. First the motion for the prosecution to deal with, and now this.
I'm surprised this kinda thing is allowed by the court with no time limits, surely you can't expect people to just show up reliably with no notice, and be in contempt of court if they don't.

I looked a little further. Both are peace officers and were "served" via Lori, whom I presume was at the front desk, at the Kandiyohi County Sheriff's Office. Service itself was Monday August 19th (yesterday). It was filed this morning at 8:07 AM. (How much money on the service being near end of business Monday?)

It is a little less outrageous to serve cops without much notice, I guess.
