Law Man in Florida arrested for creating Child porn through AI prompts

A Florida man is facing 20 counts of obscenity for allegedly creating and distributing AI-generated child pornography, highlighting the danger and ubiquity of generative AI being used for nefarious reasons.

Phillip Michael McCorkle was arrested last week while he was working at a movie theater in Vero Beach, Florida, according to TV station CBS 12 News. A crew from the TV station captured the arrest, which made for dramatic video footage due to law enforcement leading away the uniform-wearing McCorkle from the theater in handcuffs.

he investigation kicked off after Indian River County Sheriff's Office received tips that McCorkle was prompting an AI image generator to make child sexual imagery and distributing it via the social media app Kik.

McCorkle's arrest was part of a county operation taking down people possessing child pornography, but the generative AI wrinkle in this particular arrest shows how technology is generating new avenues for crime and child abuse.

Here is my problem with AI:
I draw the line at child harm. That is what makes pedophilia bad. CP is bad because you have to harm a child to create it. If you aren't exploiting or harming, there should not be a crime. This is why I don't get behind naughty pictures in anime being evil much less illegal because the reaction to those is very much in the eye and mind of the beholder. In reality they are just ink, paint and pixels and nobody was harmed to make them.

HOWEVER

With AI and impersonation being the biggest problem you can actually impersonate specific children. It would stop being an outlet for creepy people and start being a motivator. You can exploit children this way. Then it gets murkier when you consider the data that makes it possible for it to exist. Like, at worst it is trained on exploitive images and at best it is making its best guess at what it looks like from porn. While I will be quick to defend AI because people's thoughts are also "trained" on, you could also make the arguement that this is kind of a sophisticated way of clipping a child's head from a picture and putting it on porn. Is it still victimless? Well, yes potentially. It also could wind up creating forgeries of real children in not safe for life situations that goes past abhorrent and into the territory of could harm people's reputation and sanity or fuel the insanity of a very dangerous person in ways that were not previously remotely possible or practical.

Then again, if this person was just making naughty stick figures or if this guy had a sicko drunk buddy who was entering bad search terms into stable diffusion to cause trouble, fuck this case entirely. Context, material and intent matter. This article addresses none of those. May be for the best because it could just be exactly what you think reading it. Sick guy makes sick images because he is a creep who wants to hurt kids. On the other hand, it might not be that. These things matter when discussing policy on new technology.
