NEWARK, New Jersey (WABC) -- A New Jersey Transit bus driver and passenger were both arrested last Friday after getting into a fight in Newark.

It happened Aug. 16 around noon on a crowded bus at Broad and Lafayette streets.

Authorities say they responded to reports of a physical altercation between the bus driver and an adult passenger.

The fight started after the rider reportedly spit on the driver.

That bus driver had told passengers to move to the back of the bus before the fight broke out, officials say.

Newark police have reviewed video of the fight, which appears to show the driver choking the passenger while continuing to punch him.

"It's a bus driver trying to help out the community, and you did wrong to a bus driver that's trying to help us out. He's doing his job and he wants to feel safe," said bus passenger Zoey Clarke.

Both men face a charge of aggravated assault.

Eyewitness News reporter Anthony Johnson spoke to NJ Transit riders, who had a lot of different opinions about what happened, and who was right or wrong.

"He spit on him, which is physical but at the same time I think he should have called the police," Newark resident Darrel Armstrong said.

"If someone spit on me, I'm automatically hitting them," Newark resident Donna Defeo said.

The bus driver is now off the job pending an investigation.

New Jersey Transit released a statement that the issue is under investigation, so they cannot comment on specific details.

"We don't condone any form of assault aboard any of our vehicles or within our facilities. We can confirm that our driver was assaulted prior to the altercation. We want to take this opportunity to remind everyone that assaulting a transit employee is a serious offense and can result in a fine, jail time and/or a ban from riding the transit system."

Kind of on the bus driver's side here. There comes a time when some passengers need to be removed from the bus (or pummelled unconscious) for the safety of everyone on there. If the taller fellow decided to continue his behaviour while the bus was mobile it could have led to a crash, he could have popped off on another passenger or anything.

Driver got people to move back so passengers were as safe as possible before starting punching, demonstrating adherence to his job by focusing on the health and well being of his customers. Promote him to HR specifically to investigate these sort of events by other drivers and provide recommendations about the proper way to handle them.

I'd be surprised if they didn't have them, especially in cities like NY or Chicago. The amount of shit the drivers have to deal with is insane. Most of the public transport in the US ,that I've used, always had signs about any aggression towards the drivers not being tolerated and being punished with hefty fines and high prison sentences.

This dude remained professional, making the passengers safety a priority, before he proceeded to whoop that hood rat's ass. Give him a fucking raise.

Bus drivers need to be seen the same as a captain of a ship or an aircraft pilot.
The final authority and the sole level of jurisdiction of what happens in his bus.

Normal law or jurisdiction do not apply. The bus driver is the final arbitrator of law, policy and punishment in his vessel.
 
That was hilarious, was not expecting such an ass kicking to take place. Hope he thinks twice before he does that again but we all know he won’t.
Not thinking things through is the most basic trait of the niggardy thug type. Transit driver did the public some service tho.

The passenger won't have a goddamned thing happen to them, bus drivers are expected to just sit there and take it.
One of my mom's co-workers had a passenger sucker punch them and smear shit in their face. When the driver retaliated, the driver was the only one to get any charges.
It's absolute bullshit and is why the Amalgamated Transit Union needs to be investigated; passengers can do no wrong according to them.

Qualified immunity for public-facing civic workers would put an end to 90% of the niggardry that only continues because poor folks like the bus driver, just trying to earn a living, know that if they lay one finger on an asshole passenger for any reason? The city owes the passenger $50 million and the driver will lose their job, and the assholes KNOW it too.
