Depends where you do it and whether it's illegal to burn things in general. It's definitely illegal to burn one on someone else's front yard. Or as a direct threat or to cause an imminent act of violence. Or where fire codes prohibit burning things without a permit.

It's not constitutional to ban the specific act of burning a cross, though.

Cross and flag burnings are kind of different animals. Flag burning is to destroy the symbol of something you hate and there's some rhetoric about burning the cross because it represents purity from light or some shit. Both I assume are protected as long as you burn them where it's legal to light fires.

Yeah, there's been a couple of people arrested not for burning the flag, but just for open burning in that jurisdiction.
