What it looks like is they need to establish probable cause to search a possession of April's as the cops obviously don't need a reason not to search a vial when they have a search warrant.

It's on top of her cards and she is in the room. All good, but I'd imagine they'd have a problem to search her purse, even then. So you then have this messy situation of contents of the purse out, cards out and a vial on top. Is the vial clear? How obvious is it that it has drugs inside?

Can they look to claim she was more than a guest and did they need to know that before searching her property.

I think you misunderstood.

A search warrant for Nick's house doesn't give them permission to search April, if she was indeed a guest, or her purse. The search warrant doesn't extend that far, particularly now the prosecutor said she was in the room.

So they then need probable cause to search her stuff. Here is where I think they might run into problems and I'm sure her lawyer will try it.

They absolutely can't go in a closed purse to search. Emptied out contents? Dunno. How obvious was it that the vial had drugs inside?

I may be misinformed on this, but thought I recalled someone telling me that there was some philosophical/legal basis that the act of taking drugs was not criminal because there was an unrealised crime. People on drugs don't always commit other crimes, so they nail them on the sale and possession becuase the giverbemtn says it is illegal to possess or sell it, so the crime is commerical.

The practical basis of taking drugs not being criminal is that if it is, people under influence would be scared of calling medical help for overdose.

Balldo's law creed rests on winning this, I bet his ego will make him go full scorched earth and piss off the court to the point they slap him with a (short) prison sentence. If he compromises or takes a plea, he'd no longer be able to act like a smug faggot that got away with it anymore.
