I wonder what the threshold for a show cause would be in a normal case (are the elements like damages, a path to make whole, a specific tort, any others?). And then what the delta would be between that show cause and what will be required of Greer.

@AnOminous has already gave the legal perspective. My non-legal take: Show cause is usually reserved for egregious conduct that needs to be addressed ASAP. Here, the defense is ready and willing to take part in proposing a schedule, but Russ the paralegal extraordinaire can't even figure out how to fill out the form to initiate the process. Since that point, he has:

• Missed the court-ordered deadline for proposing a schedule without requesting (yet another) extension - one that likely would have been granted had he asked for it,
• Directed unwarranted profanity towards Hardin in an ongoing e-mail discussion, and
• Told Hardin to cease all communication with him outside of motions that are filed.

This seems like a sum of the parts ruling. If just one of the above three events took place, the judge could have easily given Russ a friendly reminder that the case needs to move forward on a timely basis. However, the three of these events taken together as a whole make it look like like Russ either cannot or will not move the case forward as previously directed. So, the judge - as much as he's given Russ a lot of leeway so far - has little choice but to compel Russ to explain to the court why he hasn't done so after all the time and extensions he's been granted up to this point. If the response is unsatisfactory, the judge has made it clear dismissal is a very real possibility.

IME deadline-related show cause hearings get called off if a party gets their stuff filed, but I'm more used to that in a probate context.

I'm going to take the optimistic and unpopular view that at least some of the retardation from the judge is trying to make the dismissal with prejudice iron clad under the "enough rope" doctrine. So when Greer inevitably appeals the Circuit Court won't have any possible avenue for it to continue. Obviously they will make some shit up and we'll be back here in another couple years.
