Man if you’re bitching about FL HOAs you need to do a tiny bit of research. Look up the max fine per day and max total fine. If you get on an HOA board you’re required to take a class and this is one of the things they teach.
As of July 1, 2024, yes, those fines are capped. Same with the 4-hour course that's now required. Further, they're no longer allowed to just arbitrarily bill you for their attorney's time unless a court orders it (before now, they could threaten to sue you via their attorney, never actually do it, but bill you for the attorney's time anyway), and they also can't use any single fine or penalty under $1k as cause to file a lien or foreclose to force you out, nor a combination of sub-$1k fines that exceed $1k when combined.

Prior to that 2023 law coming into effect in July of this year, no, those caps and restrictions didn't exist.

I've done a lot of research about Florida HOA laws, as the cunts running my HOA have been an endless pain in my fucking ass for ten years and I'm in the midst of getting rid of the worthless faggots. Hearing them bellyache endlessly about the new requirements and restrictions at the most recent board meeting was such a delight to my ears, I could barely contain my smirk.

Yes, I can. I can blame the land developer for imposing it, the landlord we (I was married at the time) rented from not telling us an HOA existed here, and the real estate market making it impractical to move when the landlord decided to sell (ended up buying it from him rather than spend 50% more moving to another neighborhood that would also have an HOA).

Incidentally, I hate this smart-assed response. For one thing, it's getting harder every year to find a property anywhere near a city or suburb that isn't HOA-encumbered, and for another, "lol you signed so ur fuked" is horseshit anyway since there are countless examples of courts saying "lol no ur rules suck get fuked" when HOAs misbehave.

EULAs and shrinkwrap licenses are viewed with contempt by consumer rights advocates and HOA encumbrances deserve the same derision. "This is a beautiful property with a fantastic house at a great price, but oh yeah there's a group of five arbitrarily-selected neighbors who can force you out if you leave out your garbage cans for too long" is ridiculous, and worth fighting rather than running away from. Correct, they're not completely new; they've been refined and strengthened. House Bill 1023 significantly strengthened homeowner protections.

And while I applaud your participation in your HOA, it's a shame you couldn't dissolve it instead of leaving it "sane." It won't stay that way for very long.
