The lawsuit seems dead on arrival for many other reasons. For example, she has spent zero time establishing jurisdiction even though she admits that the defamer is a California resident, and the statements are owned by a New York company (which is incorporated in Delaware). Neither of which are Florida where this was filed.


It also refuses to cite any caselaw (regarding actual malice), as well as suing over things that are obviously opinion. One of the points she is unironically raising is that she said "no I'm not fucking Trump" and that they didn't take her word for it, or that they didn't phone her ahead of time to ask if she really was fucking Trump, or that they didn't accept her demand that she be invited on their show to rebute them. The lawsuit itself is pretty weirdly written and at a point even accuses the opposition of some unspecified threats being made against Loomer.
