Summary of day two is up



First bit is legal wrangling over whether Karl's team could use the deposition tapes that were made from Billy's lawsuit against Twin Galaxies, Billy obviously doesn't want them to since he lies a lot during them and claims that Karl obtained them illegally. Ultimately the judge allows the deposition materials to be used.

Still reading it but Ersatz is claiming that Billy was communicating with his son, Billy IV, who is going to testify in this case as a witness. Billy isn't supposed to be talking to any witnesses during the case and his son can't even come to court until called. Of course his evidence for this is "some guy handed me a note" so who knows.

Karl's lawyer is trying to make the case that Billy's reputation was shit before Karl's video. Billy is apparently getting extremely angry and irritable on the stand. Judge closed out by noting the trial is extremely behind schedule, though that more seems like Billy's fault since they only brought their objection to the deposition tape when the trial started and they spent the morning arguing about it. So Karl's lawyer is gonna have to streamline his further cross of Billy.

Karl tweeted this out, which would have been during day three of the trial there.

I don't want to be a negative nancy but this all sounds a whole lot like Billy winning the case because whether he lost money from being called out matters more than him actually cheating.

Whether he cheated or not, which he definitely did, is pretty irrelevant in this trial. His main accusation is just that Karl's claims about him regarding Apollo Legend caused him stress and loss of reputation/revenue. Though frankly, Billy is claiming an insane level of stress, that he couldn't eat for two weeks and developed a heart fibrillation because of Karl's video alone.

I don't think Billy is winning, but it's not a slam dunk for Karl. Karl's lawyer on day three did show that Billy has flip flopped on which lawsuit has given him more stress, claiming that the Karl issue was "minimal" compared to his case against Twin Galaxies.

Putting the legal process aside for a moment, Jobst is one of those hbomberguy types who will identify a suitable "villain" and tell the whole world why they're evil to justify everyone rallying their self-righteous indignant fury against this villain through the "hero" figure of Jobst/hbomberguy. It doesn't work out so well when that "villain" is actually some feeble dumbfuck who was in the wrong, but will crumple under the ensuing dogpile a la James Somerton or Apollo Legend. When they're a Tommy Tallarico or Billy Mitchell then you can go pretty far.

Of course Billy Mitchell is a douche, but Karl Jobst is every bit as insufferable in his own right. If he truly cared about human decency then he should start with his friendship with that open pedophile Christopher Gesualdi instead of "he cheated at Pac-Man 40 years ago." Karl can't even claim the high ground as he's already admitted to similarly cheating to get fake scores/times published in a magazine to win a competition. He's a cheater who realized there's a lot of clout to be gained from exposing his own kind. He always did have keen insight into the headspace of these cheaters, after all.

That all said, he'll win the lawsuit and make a dozen more slop videos about Billy Mitchell.
What happened with Tommy Tallarico? All I know em from was a G4 review show.

Apparently Karl got up on the stand and cried.

Karl crying comes later in day 5, that part isn't included in this blog post though I assume the author would post it up tomorrow since it's the weekend in Australia now.

Apparently the trial is done for now, picks up again in October. I have no idea how the Australian legal system works but this seems retarded for any case, and especially for one where the plantiff is coming in from another country. Though apparently Billy will just dial in for the October portion of the trial.

Court is back in session, no day to day updates this time though since Ersatz decided to not sign up to listen in on every day of court.

Apparently Billy's US lawyer accidentally revealed a bunch of confidential stuff.




Did find a news article, basically Karl's bringing in witnesses to show that Billy's reputation was already shit at the time since everyone knew he was a cheater.

This was the first time I actually read through the entirety of one of these write-ups (instead of lazily skimming through), and it was really enjoyable!

I really appreciate how the last witness was able to stand his ground and establish that Billy's ultimate reputational damage came from his own texts about smiling over Apollo's suicide, rather than the claim that Apollo had to pay Billy, regardless of both the texts and the settlement talk being in the same Jobst video.

I also appreciate Ersatz keeping up with the slimy tactics and truth-bending of Billy's barrister, even the ones that the witnesses and Karl's own barrister didn't catch. He does a very thorough job with his overviews while keeping them engaging.

The perfectpacman Day 6 you link is a long read but pretty funny, its bizarre to hear that a fart is used as evidence.
